Hi, this is my first post, I really hope someone can help me as I've hit a brick wall, also I'm on hol
iday/vacation and the frustration is spoiling my holiday.
Basically I sold a beautiful ring that was my grandmother's, the photos on the listing show the perfect condition of the ring. I then receive a request from the buyer for a refund as the ring allegedly arrived damaged. The photos attached show a ring in completely damaged condition, my husband said it looks like they'd tried to clean it and it went wring as it is now black and marked. I told them no way I didn't send it like that. They opened a case against me. I received this at the airport & had to call EBay who assured me the buyer wouldn't just be given an automatic refund and agreed my photos show no damage. I arrive in the USA on vacation and call EBay again as the UK person advised. I spoke to someone who was so patronising I could tell they were amused at how upset I was. I was incredulous that I have to pay thecretun postage for an item the seller had damaged. I saw in the resolution centre the case was on hold. I then made a complaint about the buyer misusing the payback. Anyways the case was found against me. I appealed and this was rejected. I have over 2,500 positive feedback and the seller has 8, that might give cause for my word to be believed but I said you have photographic evidence. Now I don't see an option to pay for the shipping rerun of my ring as I had a time limit to do that or unbelievably the buyer keeps the item. But I was waiting for the result of the case being on hold. Someone with a couple of feedback could even do a scam where they remove the diamobds from rhe ring and replaced with cubic zirconas and I'd never know. This has left me disgusted that as a seller I now realise I have no protection at all. Is that anywhere at all I can go with this? Is there anyone at EBay who cares rather than the human robots who answer the phone? Please Help??

Your title is confusing as a chargeback would generally refer to a buyer filing with a cc
This is a case filed with eBay. You didn’t accept the return. Sounds like it was closed in buyers favor and eBay didn’t make them return since you didn’t accept the return? Also sounds like you already appealed and lost that? Not much you can do at this point

I guarantee the messages you received from eBay while the case was on hold (not to mention the messages prior) were crystal clear as to what you needed to do to avoid the outcome you ended up with. You didn't follow directions. Sorry for your loss.

In the OP's defense he / she did call eBay and spoke to c-s, who viewed the pictures and gave assurance that the case wouldn't be automatically ruled against them. Hard to dog pile on the OP when they simply followed advice given by the site's c-s.

While that’s true most of the posts I’m reading aren’t dog piling they’re stating facts about the ops situation and telling the op they’re sorry that it turned out this way

Verbal assurances cannot alter written policy, or so I've heard.

Hi, so sorry to hear this matter is ruining your vacation. Sadly, we hear stories like yours here in the forums fairly regularly. Sellers who are unaware of the steps they need to take to protect themselves, as eBay offers very little in terms of seller protections.
First, did you buy shipping insurance to cover your interests in case of loss or damage? On an expensive ring i am hoping so. Insurance protects the seller’s interest and eBay protects the buyer’s. That is how it works on eBay.
Their Money Back Guarantee nearly always finds in favor of the buyer, so it is not in your best interest to have refused the return. Ebay considers “faulty” returns to be a cost of doing business here, as with most retailers, sellers need to write shrinkage into their business plans.
Know ahead of time the steps you need to take when the rare scamming occasion rises. Sellers must determine their risk tolerance prior to listing that expensive heirloom. It would have been to your benefit to have come to the forum before you moved forward.with the case. There are those here who could advise what steps you could take to mitigate some of the risk of online selling. Sometimes eBays cs leaves a bit to be desired when advising eBayers.
Try not to let the bozos get you down. Again very sorry you find yourself at this impasse.

Please note, I am certainly not dog-piling on the OP. It actually hurts my heart that the OP was cheated out of their Grandmother's ring. Please also note that eBay's CS are NOTORIOUS for giving bad information that affects a seller's account... My own sister recently received information that caused her to get a defect. The CSR told her to not worry about it as the case would be closed in her favor... complete lie. By the time she contacted me, it was too late. I told her that in the future she was not to consult eBay's CS as she would not get the straight scoop. We've discussed this in the past, so I'm hoping this time she will listen to me.
To the OP... seriously, my heart does hurt for you.

This is why I accept returns. I won’t let anyone keep my item and refunded.
If you got it back and it wasn’t the one you send you can file several cases from eBay to thePost office.
It is damaged in shipping you could have opened a claim if you sent it priority. If I have something that is worth something I spend the bucks shipping priority even if it’s a small thing.

If it were me I would file a small claims case against the buyer. I would also file a theft report. Ebay or not theft is theft! This is shameful that Ebay would allow this kind of outright theft! Having been on this site for many years I had no idea theft and scamming was so rampant here. It is as if it is being promoted! Just shameful!!! 🤔

Can a person in the UK file a small claims case? I didn't read where the buyer is from, but maybe they are both from the UK?

If you sell expensive items you need to add adequate insurance to that item for cases such as this whether the buyer is telling the truth or not. Always, in most cases, not all, accept the return, or the buyer may not be required to return the item to you. If you choose to fight the buyer here, they always have a second chance to get their money back through PP or a credit card charge back. Sorry this happened.

The problem with insurance is that you need the buyer's cooperation to collect on it.

I haven't read the entire thread yet, but legally speaking, if the seller issues a refund, the buyer must return the item in question. I see you mentioned the UK site so maybe its different there, but in the US they are on the hook to return the goods regardless of what any other "policies" say if the seller doesn't agree to something else and they can be sued for this. Its fraud, otherwise.
If its a high dollar item, it may be worth pursuing legal remedies.
