Over a week ago I won an auction for an item. The next day the seller created a label but hasn't done anything since. I sent them a message a few days ago and have had no response. He has 50/50 on reviews, with 2 being positive and 2 negative. Should I wait a bit and see if they ship or respond?

You have to wait til the expected delivery date........I'd file a not received claim then.

Are you depending on the screen you gave us a pic of to make this determination? Have you gone to USPS.com, entered in the tracking number and see what that site tells you. It may have more details. It may not be your seller at fault but USPS. From the information provided, that determination can't yet be accurately made.
From what I see in the info provided the first dot is when the seller creates the label, so it is paid for at that point. The second dot says it has been shipped, so that tells me the carrier scanned it as receiving the package from the seller. And if all that is true, then there is some hold up by the carrier, NOT the seller.
I hope you will consider going to USPS and take a look at the detailed tracking. Then share it here so we can all see it and hopefully further advise you.

It is Fedex and this is what it has said all week minus the pending. Should of included it in the post.

Have you contacted your seller to see if they can give any added information?

No worries. I've had that happen. The item arrived late.
You are protected by the MBG and can file an Ebay item not received case through the Resolution Center after the last date of the estimated delivery timeframe.
Ebay went to new information in your Purchase History. The line graph says PAID SHIPPED DELIVERED, but the tracking will show that the carrier doesn't have the item yet, which is what you have said. The second dot shows shipped when it really hasn't as it is generated by the label that the seller printed.
The graph showing shipped just shows shipped because the seller printed a label.

The ETA was Friday. I'd give them until Monday and see if it comes before filing an INR.

So, it sounds like whatever good ebay did by changing the verbiage on the email sent to buyers when a label is printed has now been wiped out with this new line graph.

Yes, you're right about that and I pointed the discrepancy out to Brian in a thread. It negates all the good that the your order is preparing to ship did as it is the old your item has shipped when it really hasn't all over again.

You should probably wait a few days . It doesn't make much sense for a seller to pay to create a label and then not send the package . This is why I think your order will arrive eventually even if its really late . Looks like there's a good reason why this new seller already has two negatives . This is why I've always believed in the usefulness of checking feedback before making purchases . Tulips

Could he possibly be waiting 21 days till he gets paid? Im willing to wait up to another week or so before filing a claim.

Well maybe your seller is, which would be all kinds of wrong, but you don't have to. One day past the ETA of arrival on your purchase, file an INR [item not received] claim. That will protect you and your money.
