I put on sale a military hat made on 3D printer - made for lego minifigures.
WW2 item with the form which was never made by LEGO. So pure hand made item, lego compatible.
In the description not a word about LEGO - I used "main brand compatible" and "brick item".
So once again - even the form of the hat is unique. Material. So not a chance to be lego item.
And I got a claim that its a fake froduct... Ok...
I started the Appeal and described it.
And I got an answer today that they checked and confirmed that it s a conunterfeit product and I cant Appeal anymore and my account was banned once again.
What to do? I want to prove that its not a LEGO item. How may I do it??

Two items currently up for sale... in specifics...have the word "Lego" .

I looked at some of your completed listings and you DO use Lego in titles and description for items that are NOT Lego.
For example, in this listing, you have Lego in the title and at the beginning of the description use "Custom LEGO German (Machine gunner) Obergefreiter (chief corp.)."
Yet when one scrolls further down the description, you state, "NOT LEGO."
You're lucky all those completed listings weren't VeRO'ed!
You cannot use Lego for non-Lego items.

How others items influence this particular one?

"my account was banned once again"
Once more might the end of it.
Quit selling counterfeits.
In one of your listings, you even say they are not LEGO's.

I don't understand your question.

Remove the word LEGO from anywhere in your listing and make sure the items are NOT listed in any of the LEGO categories. LEGO is VERY protective on the use of it's brand name and serious LEGO fans and collectors are diligent about reporting fake and counterfeit items even though they are described as NOT being LEGO but are LEGO compatible.

"If you choose cheap shipment with no tracking number then I dont get any responsibility in case it's loss or damage. Its all on buyer's side."
Do you realize that the statement in some of your listings is unenforceable? If a buyer claims non-receipt and you shipped without tracking, that's on YOU and the buyer will get their refund?

Once again... Im not talking about other different listings.
Im curious why my not LEGO hand made 3D printed item for lego was banned?

I mean why you check my otrher listings?
I described the situation - hand made 3D printed item made as lego compatible.
Already had lessons from Ebay so I didnt use a single word LEGO
And still it was banned.
And even after my Appeal they checked the item and confirmed it was fake..
Looks like they dont check anything and just confirm automatically

I’m curious…..is it a patent infringement if he made both similar figures and accessories off a 3d pirinter and sold them? I’m going to guess “yes’ because people could buy from him much cheaper than from LEGO but….then is there any way around it…at all?

"my account was banned once again."
You mean you've been banned from eBay before?!?
And this is the SECOND time that you've been banned?!?
"Banned" means "BANNED" -- it doesn't mean that you get to start all over again!

They KNOW its not a Lego..... That makes it counterfeit....Stop using the word LEGO

Copyright infringement..you're lucky Lego didnt come after you, they have a very protective influence on fakes.
