Listing removed for being Counterfeit, when item is not Counterfeit

Hi everyone. So I have been selling for years and never had this problem. eBay sent me a notice and removed three listings. They said items are counterfeit. They're not. I buy them through big box stores like Macy's, etc. Also, I have been doing this for years so I can tell right away if an item I received it fake or real. So I called them but they wouldn't give me how they came to this conclusion. I told them that I have been selling for years and have 100% POSITIVE FEEDBACK. Not a single rating from a buyer mentions they received fake item and most buyers say how happy they are. So the rep said they forward it to higher dept and said she believes me and saw my profile and forward me confirmation that this violation has been removed from my account. For one week I didn't receive any messages so I called and now the second rep said I was given wrong info. I kept on pushing to tell me how they reached the conclusions and she said "I believe you're honest sir but our set of system thinks they were not authentic." Okay, so technically you don't believe me. I asked what set of system determines this. I even offered to send them those items that were flagged for evaluation and also asked if they placed mock orders to check my products but she said she couldn't give me the reason. When she offered me to send it to Authenticty Guarantee program, I told  her that's only for watches costing more than a $1000 bucks, I could be wrong. These were listed at around $70. It feels like you're accused of committing a crime which you didn't commit and they won't give straight answers. I am just afraid that if their "system" flags another listing, I may been restricted or banned. I am really worried as this is my only source of income. And above all, I feel insulted when they tell me I am selling fake because I would never do that. Its dishonest and plain wrong and I myself have been victim of buying something fake twice so I would never do that to anyone after how I felt. ANY SUGGESTIONS would be greatly appreciated.

@tdumonde2014

Not certain where you found that definition of NEW but here is the definition of NEW for Watches by eBay.

Clothing, Shoes & Accessories: Clothing and accessories, Jewelry & Watches, Sporting Goods

  • New with tags: The brand-new, unused, and unworn item (including handmade items) is in the original packaging (such as the original box or bag) and/or has the original tags attached.
  • New without tags: The brand-new, unused, and unworn item (including handmade items) is not in original packaging or may be missing original packaging materials (such as the original box or bag). The original tags may not be attached.
  • New with defects: The item is brand new, unused, and unworn. Possible cosmetic imperfections range from natural color variations to scuffs, cuts, nicks, and hanging threads or missing buttons that occasionally occur during the manufacturing or delivery process. The apparel may contain irregular or mismarked size tags. The item may be missing the original packaging materials (such as the original box or tag). New factory seconds and/or new irregular items may fall under this category. The original tags may or may not be attached. See the seller's listing for full details and a description of any imperfections.

Was not referring to eBay's "New", was referring to what Consumers and Retailers expect "New" to be.

Re: Listing removed for being Counterfeit, when item is not Counterfeit

If eBay's trust and safety team remove your listing, they will never... ever... say what evidence they have.  Its not because they are being arbitrary, but they simply won't tell you how.  Its like that because if someone knows how they are being caught, they can use that knowledge to avoid being caught.

Anybody commenting on what it could be would be purely guessing.  eBay has evidence that makes it uncomfortable with those products and have come to the decision it doesn't want them on their platform.

It is eBays rules & regs that count when selling on eBay.

"I have receipts for all those watches which I even offered to send them."

Receipts from any seller suspected of having counterfeit goods with counterfeit packaging and product information would not be reliable.

EXACTLY the questions I asked eBay. On what basis. I even offered to send them any of the products in my shop. Oh well, it is what it is. eBay is the giant here and not much we can do when their reps have limited responses and can only do so much. I feel gutted and insulted by their notice.

Yes, but I can assure you mine is not fake. I have been doing this for years and I can tell right away it something is fishy. To be honest I haven't had bad luck with Macy's or other stores I buy from, they're usually high end stores and majority of time, these items ship directly from manufacturer. It will even says that on Macy's page. This item ships straight from the vendor. I know this because many times the packaging paper represents their brand and I've also checked address items are mailed form and they all check out good.

No it is not same issue, not even remotely. That issue was regarding a picture of an item. This issue is regarding them telling me item is not authentic.

The receipts are from authorized sellers of these items and are not questionable at all.

Re: Listing removed for being Counterfeit, when item is not Counterfeit

after several years of selling on ebay we received our first counterfeit notices today, 2 total...both notices were for vintage vinyl records

BOTH are original pressing vinyl records, listed as USED VG condition ...they are not counterfeit and are not reproductions ..they are not anything ebay references for their removal criteria...we cannot get any sort of answer as to why they are pulling these items.

MY personal opinion is that another seller/buyer reported the items as counterfeit to try and hurt us as their competitor

we recently blocked another seller ( basically because he is annoying and constantly tries to barter shipping charges) he sent a nasty message about being blocked and  within 3 days we received these 2 notices..could be coincidence, but seems suspicious.

I just moved the listings to another platform..ebays loss

Re: Listing removed for being Counterfeit, when item is not Counterfeit

After selling for years, I just got my first “counterfeit” notice and removal on a soccer jersey that is 100% authentic and and new with tags. I purchased it on clearance at a major retailer and have no idea why it would be reported as fake. Maybe someone suspects that if you are selling something at 1/3 retail, it must be fake. So frustrating.

Re: Listing removed for being Counterfeit, when item is not Counterfeit

I have been selling on ebay for years without any issues. I posted a designer handbag and within 2 days I received an email (very generic) stating it was counterfeit and removed. I have sold other high-end bags in the past without issue. What is super ironic is they have authenticity guarantee for bags so this just makes no sense. none..zero. I was irate, insulted and am calling bullsh*t on ebay's process. This bag was purchased directly by me at a major high-end retailer. I did read other blogs that said another seller can flag your bag as counterfeit since the price is less and it is automatically removed....no questions asked. Nothing and no recourse. It is insane. I too plan to post on another platform. The fact that ebay gives you no reason why makes it all the more suspect.  I went berzerk on the survey because if we do not stick up for ourselves no one else would.

Been a seller for over 22 years and I just got eBay notice saying my Stranger Things DVD Season 3 was deemed counterfeit even though I put used. Twice pulled. Must be someone whom returned it reported me. Smh selling on another platform for this item .
