Listing removed for being Counterfeit, when item is not Counterfeit

Hi everyone. So I have been selling for years and never had this problem. eBay sent me a notice and removed three listings. They said items are counterfeit. They're not. I buy them through big box stores like Macy's, etc. Also, I have been doing this for years so I can tell right away if an item I received it fake or real. So I called them but they wouldn't give me how they came to this conclusion. I told them that I have been selling for years and have 100% POSITIVE FEEDBACK. Not a single rating from a buyer mentions they received fake item and most buyers say how happy they are. So the rep said they forward it to higher dept and said she believes me and saw my profile and forward me confirmation that this violation has been removed from my account. For one week I didn't receive any messages so I called and now the second rep said I was given wrong info. I kept on pushing to tell me how they reached the conclusions and she said "I believe you're honest sir but our set of system thinks they were not authentic." Okay, so technically you don't believe me. I asked what set of system determines this. I even offered to send them those items that were flagged for evaluation and also asked if they placed mock orders to check my products but she said she couldn't give me the reason. When she offered me to send it to Authenticty Guarantee program, I told  her that's only for watches costing more than a $1000 bucks, I could be wrong. These were listed at around $70. It feels like you're accused of committing a crime which you didn't commit and they won't give straight answers. I am just afraid that if their "system" flags another listing, I may been restricted or banned. I am really worried as this is my only source of income. And above all, I feel insulted when they tell me I am selling fake because I would never do that. Its dishonest and plain wrong and I myself have been victim of buying something fake twice so I would never do that to anyone after how I felt. ANY SUGGESTIONS would be greatly appreciated.

Do your "New" watches come with a factory warranty?

To be honest looking at your listings, too me, there are red flags all over the place. Are you a drop shipper ? Are you a foreign seller using a U.S. address ? Do you have receipts for all those new watches ? I don't know the policy but you may have to show Ebay proof of those questions I asked, and you may have to have them sent to Ebay's  authenticator program.

What are the etc sources?  Retail outlets are not immune from selling counterfeit items.   It would have most likely been the original owner of the copyright or trademark that requested the watch be removed.

you were using your other account to ask the same question yesterday

 

if the sale says 1 year warranty and its not a factory warranty then its gray market

selling genuine watches is easy but selling them with a factory warrant is not so simple to do

 

seller backed  warranties from watch sellers are never as good as the manufacturers warranty

the ebay authenticate program does not care a bit about most watches sold on ebay

 

if its not being sent to the authenticate team then they do not want to talk about watches

the authenticate team has nothing to do with 99 percent of watches on ebay and does not want to get involved with  watches under 2000.

 

ebay authenticate is not interested in fake watches under 2000.it coud care less.not their problem and they told me so

they will not assist regular ebay with fakes at all

 

the folks at ebay authenicate watches team do not know what a put together watch is and thats  sad.

 

the authenticators in OH are great.is the pencil pushers behind them at ebay who are cluelsss

No, but its an option in listing specific. So its not a requirement.

Umm, what red flags do you see, please tell me. How can I be a drop shipper when I am shipping the item  listed as SAME DAY HANDLING time. How do you come up with me as a foreign seller looking at my listing? I have receipts for all those watches which I even offered to send them. But I'd love to know these red flags you speak of.

They're authentic. I have sold through years and I can tell right away when something isn't genuine. You can tell by quality of workmanship, weight, logo's being different, back of case having generic info (no model number), also not all hands sometimes moving.

It is not the same topic, completely different topic. I even offered to send them receipt of all items and also sending them my items with return shipping paid by me. I only make around $10-$15 on these items so my receipt shows I paid good money for these items. I just want to know how they came up with this conclusion.

I agree and that is what I told the rep when she said send my items to authenticity guarantee program. I told her my items aren't expensive enough for them to even consider verifying them. Thanks for your help again. I just don't know what to do anymore. This is my only source of income for my family so a little worried. I've tried everything on my part to convince them my items are real, but they just don't care.

The problem is your claim that the watches are "New". " New" means they came from an Authorized dealer, allowing the Manufacturer to maintain quality control, and that the watch comes with a full factory warranty. Expect more involvement from Manufacturers, they already hold sway on the River.

Yes, but once again that is NOT a requirement. Ebay specifically has a field that asks you if watch includes warranty where you can either answer it, leave it blank or put in the time. Not everything on eBay comes with full warranty and most items do not and this is why items tend to be cheaper here than anywhere else. Its the risk a buyer takes for saving money.  Having said that, I have maybe 1-2 customers in a year who have a problem with their item and I pay to have it fixed or reimburse them. But its very rare. You are ALLOWED to sell items as new because many people do especially things given as gifts and such.

There's a big box store near where I live in Canada and all their purses (even the cheap designer stuff) is completely fake. I'm not sure if they're even aware of it, but they bought them on pallets. I can check the authenticity of a handbag when I have it in hand. The brands that were faked were not expensive stuff, like Hilfiger and Guess.

 

Stuff I've received from Macy's has been a bit questionable... so don't assume because you bought it from a retail store it's authentic. Even the outlet stores in Canada knock of their own brands (get a Kate Spade purse from the proper shop and one from the outlet, they are completely different. The outlet one is a cheap knock off but they own the brand so they're allowed to do this).
