Listing deleted as needing prescription

My listing of a CPAP mask was deleted after getting two bid.  The reason given was that the item requires a doctor's prescription.  I have been using CPAP for over 40 years now and I KNOW this is not true.  Check here if you don't believe me:

I believe I have been treated unfairly and would like to know if it is possible to protest this with eBay or do sellers just have to let them have their way and bow down?  If so, I will go elsewhere!

It is in the Prohibited items policy Ebay has.

You can always contact Ebay with your concerns.  Keep in mind that the CSR can not change the policy, but they sure can pass your concerns on to the appropriate department.

Your options will be on the left.  If you use the link below you can only get to the Automated Assistant or Chat box type AGENT in the box and hit enter. You will then get more options.  Not all options are available 24/7.  It will depend on staffing available.  So sometimes you can request a call back and sometimes you can't.  Sometimes you have the Chat option available and other times it won't me.  If it is important to you to use one of those options, just try back later.

If you use a cell phone or other mobile device, you may need to turn off your Spam filter so that Ebay can call you.

If you are a seller outside of the US or Canada, you will need to use the Chat Option.

Hi, you have to read the whole policy to understand why the listing was removed. eBay does not allow the CPAP masks to be sold here. You have not been unfairly treated. It is their policy.

That is your opinion. Mine differs.  The FACT is that the mask that I listed DOES NOT require a prescription; therefore, eBay treated me unfairly by pulling my listing.

You are certainly entitled to your opinion, unfortunately, a sellers 'opinion' doesnt matter much to Ebay.

CPAP devices and supplies require a prescription.

 

Many CPAP users do not know that their physician issued a prescription to the supplier.

 

Ebay is late to removing offers, other marketplaces have been removing them for years.

This is Ebay's site, their rules apply no matter what your opinion is or mine.  And that is a fact.  

 

You would have to address your issue directly with Ebay.

Seems as if everyone is correct.  It IS against eBays policy but does NOT require a script.  (You can buy masks over the counter at places like CVS)  It is the policy that needs to be refined.  I.M.H.O..

It is Ebay's site.  They make the rules for the site.  We can give them our opinions, but still it is up to them.

Guess i was not clear. And whoever told you the mask was removed because it needed a Rx to be sold, told you wrong. However, i understand how it may feel unfair. 

 

Fact: eBay does not allow your item to be sold here.


So i am not sharing an opinion about the issue in regards to its fairness. Its fairness has no bearing on the situation. Essentially, as long as it follows consumer laws, eBay doesn’t have to be fair. This is not not a government or a democracy where your rights are guaranteed. Selling on eBay is a privilege. 

 


Like i said, the CSR did you no favors by alluding only to the Rx requirement part of the policy. All that did was confuse the issue. But there is more to the policy than just that.

 

Your listing was removed as per the Medical Device policy. In that policy, it states that Rx items cannot be listed, in addition to other medical goods like CPAP masks that may, or may not, require a prescription.

 

Perhaps it is poorly written because eBay has dumped some items into the policy that don’t necessarily need a Rx. But it is very clear on the subject of the masks.
