Item taken down for counterfeit, though I specifically say it's an unbranded rubber beach tote?

I am so confused here. I listed a rubber beach tote bag that has no markings on it at all for sale. It was flagged and taken down as counterfit, and I lost on appeal. What?! It's literally an unbranded rubber tote bag. It's not representing any brand at all... I just don't see how it is conceivable that this falls under this policy. An unbranded rubber bag?! Are they suggesting the rubber is counterfit or something?

More to the point, show us the title. Sometimes it is not the product but the description using trademarked names.

I think it was probably just like this listing that OP sold June 23:

and then relisted again, but that listing has now been removed.

 

According to google lens, this bag looks just like a Bogg Bag, so it was probably determined to be a counterfeit of that brand's design. They're quite expensive, for tote bags.

There are tons of items listed as 'unbranded' that have no brands/logos etc.

 

Example for a big one is Apple Air Pods. Lot of non branded no logo clones.

 

They are a violation regardless that they have no branding.

As @lacemaker3 has pointed out, the technology exists to identify from a picture what product was being faked.

 

A fake is a fake, even if unbranded.

 

In China, the Chinese people would not buy such a fake. They would buy only the real thing,

 

Fakes are for selling to Americans.

I know nothing about fashion trademarks, but I can go to my local Target and buy a “Simple Modern Getaway Tote Bag” which is made of rubber with holes in the sides, virtually identical to that bag and Bogg bags. Who copied who lol

This confuses me a bit - I sell unbranded items all the time, it's one of my specialities. They have no tags, or no brand tags.

 

And I can't see how that rubber tote is against policy, unless it's a complete fake of a Balenciaga rubber tote copy of a generic rubber tote (they do that). IAC, it's sold on Amazon by one of the Chinese alphabet brands PoVwlty, Addoklm, etc.

It wouldn't be the first time Target has been accused of selling fakes.

I deal with a lot of AMZ liquidation that's just full or unbranded a lot of times 20 different no name brands for the same mass produced unbranded item.

 

Sometimes eBay hits me with this complaint sometimes they don't.

 

I'd say it's based on how much brand protection the company they stole the design from has.

How can something be "counterfeit" if it has no identifying labels, the seller is completely upfront about its lack of progeny or provenance, has received no customer complaints, and the same item, also without original branding, is being sold on Amazon? It seems, reading many sellers' complaints, that Ebay is no longer being run by thinking humans, or is increasingly treating sellers with contempt, or both.

Benefit Cosmetics didn't want me selling one of their samples so they issued a Vero as a counterfeit. They said in their emails to me that they know it is authentic but they don't allow their samples to be sold. Ebay didn't remotely care. Whether the companies are reporting it or AI you just have to not list it again and move on and hope you don't get too many in a short amount of time.

That's pretty much the policy its placed under for anything that they stole the design.

 

You can't copy a design and just say (we left off the branding) so it's legit.

 

It does not work that way.
