Buyer paid extra for priority express which requires a signature on delivery.
Then they file a item not received request. I respond to the request with the tracking which shows that delivery was attempted but there was no qualified recipient. I also inform the buyer that the item is at their local PO and to contact them for delivery.
The buyer never did take delivery of the item and it has come back to me.
Not sure how to proceed without a metric ding, there is still a open item not received case.

This one requires a call to customer service.....ebay will stand behind you as the buyer did not fulfill his obligation.
I get quite a few of these myself......normal proceedure for a seller is to refund the purchase with the costs deducted.

You can deduct all cost associated with shipping, and signature delivery.

I called ebay and they closed the item not received case and told me that if I wanted to I could issue a partial refund but had no obligation to do so.
I asked to confirm that I did not have to refund anything and they said yes.
I still plan on refunding minus the original shipping because it is I believe the right thing to do
and I would not be real confident that when the buyer called ebay back they would not reverse the decision anyway.

Not only is it the right thing but maybe what helps if buyer files with their credit card .

The seller puts themself at risk for refunding that overnight shipping if the buyer files a return case for one of these reasons.
1: Doesn't work or defective
2: Doesn't match description or photos
3: Wrong item sent
4: Missing parts or pieces
5: Arrived damaged
6: Doesn't seem authentic
The seller is also paying additional FVFs because the overnight inflates the total value of the sale.
When a buyer inquires about overnight shipping, I politely decline the sale. It does not benefit me, as a seller, to bend over backwards to accommodate these lack of planning people.
The OP might prevail with eBay. With no merchandise in hand nor delivery scan, the buyer has a case for a credit card chargeback.

I already prevailed, case closed in sellers favor
I do expedited shipping on a regular basis have never had a problem.
shipping final value fees are based on the lowest priced shipping option.

Main reason to do this is they still have options such as a payment dispute. Most will go to payment source to get a refund if such is not done the way you did it.
May still try to recover shipping costs. Hope all this works for you.
