I was scammed. eBay won’t help.

Hi. So long story short I was scammed by a buyer. I sold an engagement ring for $900. I received fake emails from eBay and PayPal telling me I was safe to ship out and that I received the money. I paid out of my pocket $50 for the shipping. Sent the package. Email said I would get paid once it was shipped because there was a high case of it being fraud because it was an expensive item. Seemed legit. Package was delivered. I never got paid. I completed the Internet crime form, haven’t heard anything. Buyer will not email back. I’ve contacted eBay multiple times and they’ve done nothing! I am now out an engagement ring and $900. Why was I not protected!? Why did eBay not know this jerk was a scammer?! I’m so mad and eBay hasn’t done a thing. Does anyone know of an email or phone number to contact a higher up from eBay? This is absolute **bleep**.

I didn't know you asked for Ebays community help last month BEFORE you shipped out the ring and still you decided to IGNORE everyone's advice then to NOT SHIP TILL YOU ARE PAID!  They told you it was a scam!

 

You asked for advice last month and good, honest, trustworthy people took their time and gave you good, honest, trustworthy advice.

 

As someone earlier before me said, you brought this on yourself.  I agree.

Unfortunately, there are a lot of scammers out there.    You should never ship item until EBAY website shows "awaiting shipments".

I know what I would do but can't type it here.

 

First mistake was selling a $900 ring on ebay.  I sell all my spare jewelry to the local coin shop or jewelry store.

I have no experience with giving a scammer my email, getting fake emails, suspecting they're fake, getting advice that they're fake, being told it's a scam, getting advice to not ship, shipping anyway and getting ripped off.

 

Wouldn't matter if I did....any advice isn't likely to be followed anyway.

Sounds like to me you fell for a "text me" scammer.  Did they get your email address because you gave it to them?   

I am so sorry you were duped.  It used to be suggested that communications that came via your ebay messages had some sort of implied veracity.  That is no longer the case, and is the one of the main communication sources used by criminals that want to get your merchandise for free,  Typically, it is done via the fake payment notification such as happened to you, or the phony parcel redirect scenario just to name two. 

These people work the ebay site 24/7.  eBay know they are here, but it is not ebay that loses the money nor the merchandise so there is no help from them.  You can't even "report the buyer" on the site since you never had one unless you accepted an offer through the make an offer feature.

I can't post on the M2M board, but frequently read the posts. (You never know when you'll need what info... you know?)

I remember that very thread and the clear, concise responses from good sources... all saying "Stop!"

I thought for sure the OP was convinced.

What in the world happened between receiving all that good advice (your words: "Looks like I need to cancel the shipment ASAP.")  and shipping that lovely ring? I can't even fathom that you expected a different outcome.

 

And I still feel bad for you... it's an expensive lesson, but a life lesson. 'Respect your elders', I guess...

I think the OP regrets his not listening to the advice he received in December. What he is doing here now is looking for advice on how to proceed, though that is not what he said in his opening post. He is likely more angry at himself than eBay.

As for how to proceed, I would send a registered letter to the scammer and also an email. However you have to contact them. Let them know politely, and without vitriol, that you intend to bring the situation to the attention of the Postal Inspectors, the police in their and your jurisdictions, and that you will sue them as well. That is, unless they send you the ring or the payment.

 

Scammers hate being on notice with the law. This is less likely to work if you have already sent angry diatribes, but it is worth a shot. Be persuasive, don't harass, keep your cool. Let them know that the Postal Inspectors will be particularly interested in them during an investigation into the crime, as it is a federal offense to use the mail system to defraud. (The United States Postal Service is a federal agency. Because of that, the law categorizes mail fraud as a federal offense. The potential prison penalty for such a crime is very high. Each offense can result in a sentence of up to 20 years in federal prison.)

 

This is all assuming the scammer is domestic and not international. It may not be possible for you to actually sue the scammer in Small Claims court, but they won't know that for a fact even if they suspect you won't act. But the whole idea here is to convince the defrauder to return your ring or make payment because it will be too risky not to. Keep in mind, being that a month has gone by, they may no longer be at the address you sent it to, so the effort may be in vain. But it is better than doing nothing.

 

As for your blaming eBay, they cannot protect sellers from themselves, though it would be better if they made these scams more well known to new sellers. However, even then, eBay would still have to rely on members to read the User Agreement and policies. Those policies are eBay's way of helping to prevent fraud on their platform. There is just no way for eBay to save sellers from a lack of knowledge, or impulsive behavior, while using their service.

While you're right that anyone can be scammed, I must say, not anyone can be scammed in this way. 

 

Rule #1: NEVER DO ANYTHING OUTSIDE OF THE NORMAL PROCESS

Rule#2: NEVER SELL ANYTHING ON EBAY YOU CAN'T AFFORD TO BE SCAMMED OUT OF.

Rule#3: PERFECT RULE #1

You did not receive fake emails from eBay and PayPal you received fake emails from the scammers. 

Why did you not check and verify through your accounts that payment was ok?

To late now but in the future only trust the platforms you are selling on. I'm sorry this happened to you but lesson learned? 

I know at the moment the money sounds good but please be more careful in the future.

I replied to this thread days ago after I found your original post BEFORE you shipped.

YOU were warned by many here and you even said yourself that it was a scam.

 

SORRY but you let greed take over and now you cry about being scammed even when you KNEW you were being scammed and other's here warned you.

Sorry but you got what you deserved and hopefully learned a lesson

I got scammed from a guy out of China who sells the same winch over and over. Then he claims the post office lost it and tries to make you buy something else from his store. I finally got him to issue a refund and it came in for $0. I contacted eBay several times and they keep hanging up on me - I checked out as a guest. They keep asking the name of my bank, what type of phone or iPad I'm using, who is in my household - they're not going after the seller - they're gathering as much information on me as they can because I refuse to download their app.  

eBay is part of the scam - you don't go through this nightmare as much with Amazon or other online retail stores. eBay is definitely being protected by communist and politicians. 

 

There should be no reason I have to give the name of my bank, the type of computer or phone I'm using? They keep trying to get me to download their crap so they can put more cookies and invade my life.

 

When you check out as a guest? You do it to avoid eBay from taking over your phone.

 

But if you get scammed? eBay is going to go up your life and through your finances - they will insist on knowing your bank, what kind of device you're using, how many people are in your household - they ask questions that have nothing to do with the refund.

 

But they will not investigate the seller. I have been hung up on several times because I refuse to turn over what type of computer I have and I won't accept their link. I bought something as a guest so eBay could not invade my life - they'll find a way. They're holding my refund hostage until I turn over all the personal information that I didn't need, to purchase that item.

 

They have to be in bed with some government, because the type of information they are asking? Has nothing to do with buying and selling on eBay.

It sounds like you were not contacting eBay -- most likely you were contacting scammers that wanted to steal from you.

The only way to contact eBay directly is through eBay's Help & Contact page; there is no public phone number for you to call. The numbers you find on search engines are from ads put up by scammers looking to steal from you. That is why they are asking about your bank and your personal info.

For help with a guest transaction you must sign out of your eBay account and use the email you received from eBay about the transaction as a starting point.

In the future if you want help on the community, you may want to start a new thread about your issue rather than replying to an old thread about a different subject. That way your post will be seen by more folks that can offer suggestions and help.

How did you contact eBay?  They don’t ask for that type of information so if you contacted them by getting their number on a search engine, you are talking to a scammer not ebay.

How long ago did you make the purchase and when was the estimated delivery date? When you checked out as a guest you should have received an email confirming your purchase and a link where you could file an item not received claim.  But you have to file the claim within 30 days after the estimated delivery date.  Did you do that?
