Buyer purchased a lovely japanese custom moriage plate. Shipped in bubble wrap, 3 times. Put into a solid wood box. Put into a larger box wrapped in bubble wrap 3 times and filled with peanuts. It wasn't going anywhere.
Receive email today. Plate totally smashed. Asked for photo's as I had insurance on the plate and then I would refund.
Oops.....sent the plate as a present to her sister. No phone, no internet. Say's could return via post office, but that nullifies insurance.
What's the next step?

Yeah, I would call cs and state I need a picture OR let's have the buyer file the insurance claim. Sounfd good? Someone at CS might think that's a good idea. I hope!

This is what you NEED to do in this situation:
Apologize to the buyer for the item arriving damaged. Then, tell buyer to request a return for the reason item is damaged. Do not explain further, do not argue, do not engage in conversation. Simply have her to request a return.
But this is what's fishy... she didn't have photos, nor did she have the plate in her possession. She probably will not try to return, and forcing her to do so will probaly make her go away.
Theory often times does not match up with real life experience, especially when it is YOUR money you are having to put where your mouth is.

Things are all good and I have reported her. She has not responded since I told her to file a return.

Because I believe she sold my plate, then purchased it from me and then I ended up shipping to her buyer.

Looking at her sales history I doubt she flipped that plate; plus, there really wasn't enough meat on the bone to flip it that quickly for enough of a profit. At the absolute best she would have made $50, and dealers don't buy items for $100 and flip for $150, at least not smart dealers anyway, and definitely not for what is usually long-tail items.
So I think there's some truth to her story, but just the part about a gift to the sister. Or maybe it was a sister in law. Or a gift to somebody she knows.
I think one or both of these things happened--1) $100 gifts are out of her price range and she had buyer's remorse trying to impress, and/or 2) she had a disagreement with the receiver shortly after giving the gift and has gift remorse.
Maybe one, maybe both!

Ah. So you found an online listing somewhere in which she sold your plate? How much did she fetch for it?
Technically, selling an item that you don't actually have is a violation, though I doubt it's really very reportable if she followed through on her sale by promptly buying on yours, thus delivering the goods to her buyer as promised. The only proof of that particular violation would be her sold listing for the same item, and without that listing to point to, all you'd really have is a sale to an alternate address someplace... which is legal.
Did you find an actual line item in an on-line Report menu for that, or just talk to Customer Service about her? If the latter, I suspect you were wasting your time, as they'll make sympathetic clucking noises for you, but it does not appear that there's any actual proof of wrongdoing to be acted upon here.

I'm happy it's done and over with. Whether the plate is damaged or not in reality, I have no way of knowing without pictures.

any reason why u can't just file a claim online tell the buyer to keep all material and refund?
The buyer refused to submit pictures of the damage because the item was NOT damaged it was a lie they had no broken item to show her, people rarely win insurance claims without proof especially something like pictures of the broken item.
the last time i filed a claim around 2014, i submitted no pictures and the USPS paid my claim in 1 week.
the time before that in 2012, same thing.
each time i mentioned, the broken item was in the possession of the buyers.
i must have missed something else along the thread.
perhaps the buyer insisted on a return, guessing the OP wouldn't want to pay return shipping on a broken item?

I would say return for refund and eat the ahipping cost. As far as insurance, I don't know if they'll take a claim without pictures, so best bet is to just return for refund.
If he is making things up, I'm guessing he won't send them back.
things must have changed since 2014 because i have never ever provided pics of a broken item.
even though the last time i filed a claim online, i could have uploaded a pic of the broken item.
nowhere did it say it was "required".
i bypassed the option and said the damaged item was not in my possession.

as a seller i am not a detective.
as a seller all i can do is get this buyer off my back.

i assume the buyer is saying she cannot send pics of the broken item since she doesn't have the plate.
and her sister cannot send pics for she has not internet or a phone...
well I would file an insurance claim with the USPS providing no pics.
the few claims i have had, i issued a refund to the buyers right away.
in this case i would hold the refund till i hear from the USPS.
if denied...
i would tell the buyer to open a case and to return for a refund.
this situation is a matter or principle.
i would even pay for return shipping.
i am glad such situation on ebay are NOT the norm.
i am glad to say that 99.99% of my buyers are "good" people.
and 100% of my sellers have been awesome (have always been satisfied with my purchases).
