Fraudulent buyer UPDATE

So eBay has completely let me down.

A rundown, eBay refunded the buyer on December 26th when I opened my last thread where my PayPal went negative. My appeal was denied despite sufficient evidence and even a police report against the buyer. 

 

A couple days ago the buyer opened another case on PAYPAL and then last night ebay DEBITED ME AGAIN(!!)??! To refund the buyer. 

basically the buyer got two refunds and now wants a third one.

Original transaction refunded on December 26th caused my paypal account to go negative 

 

 


chargeback from buyer filed on saturday

 

and a refund to the buyer (again) from eBay last night

 


AND to top it all off now eBay is telling me I can’t sell anything anymore. Even though the buyer was the one trying to scam me. Now the buyer has TWO REFUNDS

AND MY BAG

 

and obviously they got greedy and wanted a third one from PayPal. Yet I am the one who is being punished unfairly. I have NEVER had any case opened against me (or even opened any kind of case against someone) in 10 years of buying and occasionally selling on eBay. 

So I basically lost nearly $8000 and a $6000 bag. 

I called PayPal and they told me it’s an eBay problem, I called eBay and they told me it’s a PayPal problem.

 

Completely unfair despite no history of claims and disputes opened against me, yet the buyer had abused this system before and eBay ADMITTED that! 
but they said there’s nothing they can do.

This can not be legal.

 

So what are my options here? I am livid.

Gosh,

 

There are over 400 posts here, kind of hard to bottom line just pick out the important things, I seldom make any posts on these boards but OP, maybe one of the great sellers here on this board who somehow keep up to date with Ebay and their numerous changes, can help you with making a (relatively) short and sweet bulleted summary of all this and you can submit to Ina @ Commercebytes just to see what if anything she has to say.

 

I very well could be wrong, please forgive me if I am ... but it seems, I don't know ... that Ebay refunded ... then Paypal (or Ebay?) by mistake paid the "buyer" twice, and the 2nd withdrawal from your credit card(?) is Paypal (or Ebay?) trying to reimburse themselves for THEIR mistake in paying the buyer twice ??    

 

I think you said (amongst all of these posts) that you are being suspended from selling on Ebay now (I'm sorry if I am wrong)?  Ohhh yeah if you file a chargeback and they have to "eat" their mistake in the amount of what, $4K ? ohhh yeah they don't want you back lol.   File the chargeback !!!

 

I would love to see this summarized on Ina's site Ecommercebytes just to see what if anything she has to say, but I think it has to be submitted via a to the point bulleted format.


I am not here to debate anything, just trying to somehow help OP.

 

It is sooo true what sellers say here, do not list anything of any $$ that you can't afford to lose.  

 

I am NO business expert but you know, brick and mortar stores set their prices to include what they paid for the thing, profit, anticipated shrinking/shoplifting, overhead costs etc... so it seems like the same thing would need to be done here at Ebay.  For small sellers that don't sell much, to then sell an expensive item ie $4000 it seems a small seller doesn't sell enough items to be able to include anticipated "shrinkage" in their price, someone is taking such a chance selling a really expensive item here when they sell relatively few inexpensive things.  

 

Hope this makes sense, sorry the post is so long.  I am a little bit rambly at times lol.  And I haven't had my coffee yet.

the op said back in post 339 that they needed a break from the thread as recommended because the accusations were adding to their stress.    They said they would come back to the thread in 5 business days which is when eBay was supposed to have the money sorted out.  That was on the 7th so still a little while before they’ll be back

Maybe she acquired legal counsel. They would tell her to stop posting on any social media (if she has) and to stop posting on public forums.

Or -- maybe a 'gag order' from eBay.  I do believe that the OP will be back at some point and let us know that she is OK.  I don't think we will ever 'know the rest of the story'!

This thread could rival 'The Edge of Night', 'As the World Turns' or 'All My Children'.  And, still going, making the Energizer Bunny look like a wimp.

Not saying 'NO' doesn't mean 'YES'.

Perhaps if Brains were described as an APP, many people would use them more often.

Have to chime in here...

 

buyer jumped the gun by filing INR too early. 

 

USPS delivered item 2 days later. 

 

So buyer has the item. 

 

Why should buyer have item + 2 refunds?

 

why did buyer file with PP after receiving the first refund?

 

so much fraud!!

It's possible she will damage the bag if she has to return it.

I had a customer who did that, demanded a full refund because she didn't like it when she received it and I told her to return for a refund minus a restocking fee. So she changed her complaint to "damaged in transit." I told her the package had insurance and she should take it to her PO for a refund.  The PO determined it had been intentionally damaged, which she reported as "damaged by seller before shipping," and instantly got her money back.

 

Then she sent me the items back.  She had damaged them with pliers.  To top things off, she opened a case with PayPal and her credit card and got 2 more refunds because 8 years ago they weren't very good at talking to each other. Then I get a message that she had used a stolen credit card to buy the items and the credit card owner would sue if he didn't get a refund.

I lost that battle 4 different ways.

Seems like the original $3800 price should have generated a whole bunch of fees and interest for PayPal, eBay, and the CC company as much as it is moving around.

Reddit thread seems fishy to me. I'm still not convinced. Buyer states "OMG that is the seller" as if she didn't know this thread existed, then goes on to state "actually I have read all 3 threads by the seller". Why did she use reddit instead of the buying board? How is it that she had no idea these threads existed yet we had throw away accounts posting on these threads regularly and then goes on to say she read all 3 threads by the seller? If she doesn't know how to use ebay boards, how did she find all 3 threads after all her innocent she had no idea "OMG" statement? Really? 

I don't know what happened, but I smell something is off still.

I agree with that. The alleged buyer's story on Reddit has holes in it, though so does the seller's story.

 

There is one thing that I think speaks pretty loudly here: eBay removed the listing in question. They wouldn't have done that unless some kind of SNAD/counterfeit claim was made. The seller's account was also suspended. These 2 facts lead me to believe there was a SNAD/counterfeit claim that was undisclosed by the seller.
