Fraudulent buyer UPDATE

So eBay has completely let me down.

A rundown, eBay refunded the buyer on December 26th when I opened my last thread where my PayPal went negative. My appeal was denied despite sufficient evidence and even a police report against the buyer. 

 

A couple days ago the buyer opened another case on PAYPAL and then last night ebay DEBITED ME AGAIN(!!)??! To refund the buyer. 

basically the buyer got two refunds and now wants a third one.

Original transaction refunded on December 26th caused my paypal account to go negative 

 

 


chargeback from buyer filed on saturday

 

and a refund to the buyer (again) from eBay last night

 


AND to top it all off now eBay is telling me I can’t sell anything anymore. Even though the buyer was the one trying to scam me. Now the buyer has TWO REFUNDS

AND MY BAG

 

and obviously they got greedy and wanted a third one from PayPal. Yet I am the one who is being punished unfairly. I have NEVER had any case opened against me (or even opened any kind of case against someone) in 10 years of buying and occasionally selling on eBay. 

So I basically lost nearly $8000 and a $6000 bag. 

I called PayPal and they told me it’s an eBay problem, I called eBay and they told me it’s a PayPal problem.

 

Completely unfair despite no history of claims and disputes opened against me, yet the buyer had abused this system before and eBay ADMITTED that! 
but they said there’s nothing they can do.

This can not be legal.

 

So what are my options here? I am livid.

The OP hasn't ruled out trying to dispute with her bank in her correction to your post.  She just posted she hasn't done it yet.

But early you stated from what it appeared with PM that OP told you that it did clear and she had the fund still in her personal bank account?
I even asked OP regarding this and haven't gotten a reply back. Because if she didn't still have all the funds still in her personal bank account to cover the refund this is where Ebay most likely went in and billed her for the amount and now she's got a Paypal charge from ebay going on her dad's CC.

I think you may have misunderstood what I said.  And I'm sure I said something that was confusing as well.  So that is on me.

 

The buyer HAS been refunded.  The money came from the seller's bank account.  My misunderstanding was I thought the OP disputed that payment with her bank, but I was wrong.  

 

The buyer's initial refund was processed and paid. 

 

The things remaining as issues for the OP are:

 

The appeal of the reversal of the initial INR as the buyer has received the item.

The appeal of Ebay issuing a SECOND refund to be funded by the sellers CC on file.

The appeal of the removal of selling rights for the seller.

If you haven't already use this email to have evidence included in a charge back case so the CCC can also see the evidence the email is: chargeback_response@paypal.com

make for sure to get the case number id from your Case summary on Paypal and use that in the subject line of the email. Attach screen shot photo's of your refund shown in paypal and also the screen shot of the ebay message making sure to show the item description and attach those to the email to send to paypal charge back department.

This kind of goes with the OP being a bit overwhelmed by all this.  Her statement contradicts itself.  She stated that the bank can't / won't reverse the charge to her account.  So trying to dispute it with the bank would serve no purpose.  If the bank won't reverse it, there is no need to file or ask for a dispute on the charge.  At least that is the way I read that.

Hi @style.by.me29, while I won't be able to discuss the specific details of the OP's situation, I can confirm that if a buyer opens a credit card chargeback, any case on eBay is automatically closed.

Hi @style.by.me29, while I won't be able to discuss the specific details of the OP's situation, I can confirm that if a buyer opens a credit card chargeback, any case on eBay is automatically closed.

While I believe that to be true, what about when the case on Ebay was reversed in appeal by the buyer.  The buyer has been refunded.  And then the buyer days AFTER the Ebay INR appeal was closed, they open a chargeback in PP.  

 

Then what does Ebay do?  The can't close the case in Ebay as the case was already closed.  So what if anything does Ebay do about this?

Also if that buyer used a CCC card to pay for the item that refund amount would have gotten put back as credit on their CCC card they used to make the original purchase.  I've never seen an refund go into my paypal balance when I've paid for something thru pp with a credit card & ended up getting a refund because of any type of transaction with a payment made with my paypal to any platform. It has to be a CCC used to make payment or they wouldn't have been able to open a charge back to begin with. Banks typically do not allow charge back on Debit Cards. So this CCC should see at some point they amount was refunded back onto the CC. So in essence no chargeback to process. If so they most likely opened it right before it went into credit on the CC, but should close out once it's caught onto. Just my theory.

I think you might be asking me why my account was restricted two weeks after it was hacked. Here is the answer.... no clue.  eBay fixed it - it took some time....I concluded only that when something bad happens to an account such as a hacking, eBay will at its discretion shut down an account to take a breather and sort things out. When and if that happens it will take time to resolve - but in most cases it will be resolved.  Aside from the hacking, there was nothing problematic about the account.

You are correct.  

 

Sometimes what happens is that we don't see those credits hit the CC as fast as we'd like.  It is possible that the buyer filed the INR in PP because they didn't see it post to their CC yet, even though the refund had been processed.  This could all boil down to the timing of how transactions posted.

 

Also a seller has no control over where PP processes a refund to.  That is part of PP's job and as you have described it is suppose to be to the original funding source.  In this case a CC.

Sincerest of apologies! I just reviewed all three bazillion posts in this thread and see that more than a few posters suggested that you should dispute the debit to your bank account, and even a few posters who stated that you did dispute the debit from your bank account. Finally, I saw your posts stating you did not dispute the debit to your bank account because you feel that debit is valid.

Why do you think eBay could or should do anything about the credit card chargeback the buyer filed? The seller needs to sort that out with PayPal, not with eBay. eBay has provided the seller with an invoice and messages and case details that they can submit to PayPal showing the buyer was refunded through eBay. On top of that PayPal has documentation for the second refund through PayPal.

 

There's nothing for eBay to do relating to the buyer's chargeback. The seller is not in managed payments so eBay has no responsibility on that issue. The eBay case is closed and the seller has to work with PayPal to manage the buyer's chargeback claim.

Ok Got ya! So sounds like echeck wasn't clearing/hadn't cleared yet& somebody else from ebay went around and just did up a bill for this amount and put in for a automatic deduction and your account again, bank account didn't have the amount to cover the amount a second time, so it gets put on your dad's CC. So ebay needs to right this and doesn't sound like they are taking action to remedy the fact that they turned around and billed you for a refund that had already taken place and they can clearly see from evidence you've provided from the refund issued to buyer thru paypal. Sounds like ebay also issued the buyer a refund & you as well and ebay screwed up and then went and took the money again from your dad's cc. I mean why else would ebay charge for that amount go on your paypal account and it's not even time to do automated selling charges, those get automatically taken out  thru paypal at midnight PST time for ebay bills. Plus you wouldn't owe ebay that amount of money for selling fee's to begin with on a $3800 something purse. In the user agreement you do agree to allow ebay to automatically deduct your selling fee's owed to them, but it doesn't give them the right to add amounts onto that for refunds already issued to buyers. So if they don't make this right with you, I'd lawyer up!
