Ebay price guarantee selling iPhone 6s denied -- seems incorrect

I had received the price guarantee email (for $311.12) when I listed a 128GB Rose Gold iPhone 6s.

 

I sold two phones, mine and my wife's. Both had guarantees. My 64 gB model guarantee was honored, and I was sent the coupon.

 

When I did not receive anything on the 128 GB model, I called in. I was told it was deemed ineligable because of in my description I put "Two very small missing color spots on the back (see picture). " and thus it was deemed not meeting the conditions of the offer. Here's the listing photo of the back of the phone:

I looked up the conditions of the offer, and per my phone conversations the following are the relavent eBay summary of the exclusions include:

  

  • Listings must have an accurate title, description and photograph of the actual cell phone being listed.
  • Listings must have a reasonable shipping charge, defined as the lesser of $15 or the average, usual, and/or customary range for similar or identical cell phones.
  • Listings not created through the use of a catalog made available through eBay are ineligible.
  • Items in "For parts or not working/repair" and "Seller Refurbished" condition are not eligible for the Promotion.
  • Items with a cracked screen, non-functional camera, broken buttons, prior water damage, or otherwise in a poor cosmetic and functional condition are also not eligible for the Promotion.

I strongly believe I fully complied with this. I included pictures of the actual phone, front and back. I accurately described the phone -- perhaps too accurately. I cannot believe the two flecks in back picture reach the level of "poor cosmetic" condition.

 

Is there anyway to get this decision revisited and get the price guarantee applied?

 

It would be nice to get the $26.11 price guarantee coupon and the additional $20 gift card vs the questionable not eligible decision.

I'm not sure who at eBay stepped up to the plate, but I received an eBay coupon for $40 for selling my iPhone.

I will consider this matter "corrected" / "fixed", but it does taint how I will look at any future special promotions.

Hi @cmodathome, it looks like the Cosmetic condition was listed as Excellent which would not align with the cosmetic defects you outlined. When there is any conflicting information in the listing, it disqualifies the item from the price match guarantee offer you received. It did indeed say it was excellent.

 

I guess eBay and I will just have to disagree on those two little spots taking away from an excellent condition assesment.

Does the fact that the buyer recieved the phone and is happy not taken as any indication that the description was correct?

What is the Promotion?

Sellers can create a Qualifying Listing in an auction-style format. eBay will provide the seller with a guaranteed price for a qualifying cell phone, as updated in the listing flow and determined in eBay's sole discretion ("Guaranteed Price"). To be eligible to receive the Guaranteed Price, the seller must accept the recommended starting price, format, and duration provided by eBay upon listing ("eBay Recommendation"). The seller is not required to accept the eBay Recommendation to complete his/her listing, but sellers that do not accept the eBay Recommendation will not be eligible to participate in the Promotion. The starting price of each Qualifying Listing must not exceed the Guaranteed Price throughout the duration of the listing. The "Buy It Now" feature, fixed price format listing, and selection of a reserve price on listings are prohibited; listings with these selections are disqualified from the Promotion. No guarantee is made that any item will sell. Sale of a cell phone is a condition precedent of the Guaranteed Price and the Promotion. If the seller creates a Qualifying Listing and his/her cell phone sells, but at a price that is less than the Guaranteed Price at the time of listing creation, then seller will receive an eBay coupon equal to the Guaranteed Price less the price at which the cell phone sold ("Guaranteed Price Coupon"). The selling price shall be deemed to be exclusive of any sales tax, duties, shipping costs, and eBay fees that might be applicable. Guaranteed Price Coupons will be fulfilled approximately one (1) to two (2) business days from receipt of payment on the Qualifying Listing from the buyer, as applicable, and must be redeemed by the seller within thirty (30) days of receipt of the Guaranteed Price Coupon.

In addition to the Guaranteed Price Coupon, if the seller creates a Qualifying Listing between September 6, 2017, at 00:00:01 PT (12:00AM plus one second) and December 31, 2017, at 23:59:59 PT (11:59PM plus 59 seconds) ("Qualifying Dates") and his/her cell phone sells, but at a price that is less than the Guaranteed Price at the time of listing creation, then the seller will also receive a $20 eBay Gift Card ("Gift Card"). To qualify for the Gift Card, the cell phone must be listed following eBay's Listing Recommendations during the Qualifying Dates. Only Qualifying Listings that comply with all eligibility requirements for the Promotion will qualify for the Gift Card. The Gift Card is non-exchangeable and can only be redeemed on www.ebay.com. The seller must have an active PayPal account to receive and redeem the Gift Card. The Gift Card will be sent by email, and in the seller's "My Messages" on their eBay account, to eligible sellers approximately one (1) to two (2) business days after the seller receives the Guaranteed Price Coupon. Use of the Gift Card is governed by eBay's Gift Card Terms and Conditions.

Only 7-day listing durations in an auction-style are included in this Guaranteed Price promotion ("Promotion") (but may be subject to the listing upgrade fee). 1-, 3-, 5-, and 10-day listing durations, as well as any fixed price format listing durations, are excluded from this Promotion. The Promotion does not apply to insertion fees, final value fees, or optional upgrade fees. Final value fees will be applied to the total amount of the sale, including the cost of the item, shipping, and any other fees a seller may charge excluding any sales tax. Fees for optional listing upgrades apply. The item must sell within the initial listing time period. Re-Lists and Private Listings are not eligible for this Promotion. Note that use of the "Sell It For You"/ eBay Valet features will not result in a Qualifying Listing. Please also note that the Promotion may not be shown during the listing process.

To be included in the Promotion, a Qualifying Listing must be a bona fide listing that includes: (a) a correct title that accurately reflects the cell phone being sold; (b) an accurate photograph of the cell phone being sold; (c) an accurate description of the condition of the phone; (d) shipping costs that are the lesser of $15 or the average, usual, and/or customary range for similar or identical cell phones. Cell phones that are stolen, activation locked, or otherwise unusable may not be included in the Promotion. All existing selling limits on your account (as well as category and item limits) still apply, and may prevent you from participating in the Promotion. Who's eligible?

This Promotion is available to sellers who (i) are registered and in good standing on www.ebay.com and (ii) meet eBay's minimum seller performance standards. When is it?

Summary of Restrictions & Exclusions

The Promotion is only valid for phone listings on the US site at www.ebay.com in the Cell Phones and Smartphones category (9355), seller must accept the eBay Recommendation, which includes starting price, format, and duration.

Listings must have a reasonable shipping charge, defined as the lesser of $15 or the average, usual, and/or customary range for similar or identical cell phones.

Listings not created through the use of a catalog made available through eBay are ineligible.

Items in "For parts or not working/repair" and "Seller Refurbished" condition are not eligible for the Promotion.

Items with cracked screens, non-functional camera, or prior water damage are also not eligible for the Promotion.

If buyer pays through a non-PayPal payment method, then seller must mark payment as received on orders page in order for eBay to issue the coupon. By marking payment received, seller consents to required final value fee.

Revising the listings after receiving the guarantee offer will void the guarantee. Any attempt to withdraw revision(s) will make the Promotion void.

Items that are automatically relisted will not be eligible for a Price Guarantee.

This promotion does not apply to Auction with Buy It Now, Fixed Priced, or Good 'Til Cancelled format listings.

LIMIT TWO (2) QUALIFYING LISTINGS PER PERSON AND PER EBAY USER ID DURING THE PROMOTION PERIOD. If it is discovered or suspected at eBay's sole discretion that a seller has registered or attempted to participate in the Promotion more than twice using multiple email addresses, multiple identities, multiple eBay User IDs/accounts, proxy servers, or like methods, all of that seller's listings will be declared null and void, and that seller will be ineligible to participate in the Promotion. If so, it appears to me that had the OP NOT mentioned the two spots in the photograph it would have been disqualified as well. Also, the restriction only applies to how the title and photo appear and not item specifics. Isn't condition an item specific?

Hi @gramophone-georg, the portion I am referencing is related to my previous post where I discussed an accurate description of the item. The Terms & Conditions state " (c) an accurate description of the condition of the phone" as a reason for a listing not being eligible. The description includes the written description, the item specifics and the photos of the item. Since there are cosmetic defects and the item is listed as being in Excellent cosmetic condition, the listing would not be considered accurate.

I would call that excellent any day of the week.

 

Like I said, ebay will do anything to not have to pay a dime to anyone - especially on the promos that probably changed their mind about selling it on here.

 

Think that this seller is going to use another promo like this or sell another cell phone here? I doubt it.

Condition is ALWAYS subjective. Like I said, obviously the buyer is happy. He got a deal. The seller on the other hand? At least eBay actually followed through on one of the two.
