I received an order from Portland, Oregon for several pair of shoes. I sent the item and then the same day as delivery the buyer sends in a photo of another item and request a return. My returns are set to automatic ebay charged me $32 dollars for return shipping label. When the fedex arrives my heart droped , the buyer returned nothing. He just printed out the envelop and placed it on a fed mailer.
I submited a case to ebay and they said I won then 2 days later they said the buyer appealed and won I applead again and lost. I googled the address and multiple people are being hit with the same type of scam. This ebayer has no feedback other than the 1 feedback I left him which ebay also won't let me change.
I am at a loss for words as to how ebay can let someone do this. Is there anything I can do or do I just need to stop selling on ebay?

Was the buyer using a freight forwarder?

You need to get a letter from FedEx stating what was returned, an envelope, not a package.
File mail fraud with USPS and a police report.
Once you have all that, use it to appeal the case.

I am going to assume the buyer used NAD as the reason for the return. What as the address in Portland? If it was a freight forwarder the buyer would have lost their MBG coverage once the item arrived at the FF. However, with the bots handling a lot of the eBay cases the BOT has no way of knowing the address is that of a FF and since the item shows as returned the bots automatically rule in the buyers favor.
You need to appeal and this time provide the shipping address, the company information and let eBay know the item went through a FF. This is one of the down sides to having returns set to automatic. Had you not had that setting you would have had a chance to respond to the initial buyer claim and provided the FF information.

I would record all serial numbers. Not sure if shoes have serial numbers though
Ebay knows there are Thieves but they refuse to do anything to them. It's not Ebays stuff, it's yours and that's a loss they're Okay with.

the address was 6610 NE Mt St Helens Ave Portland, OR 97250-9605
ebay closed the case and took the money out of my account. I will start looking for other options and stop selling on ebay, I can't belive how easy they let this person scam me . For them to not even attempt to research this shows ebay just doesn't care about me as a seller.
Sadly I have recieved 4 more orders from this address as they now know I am an easy target and ebay will allow them to just get my products for free. I cancelled the orders and ebay as now added transacation defects to my account for not sending the items.

The only way you will NOT be scammed is to sell in person, cash in hand. Thieves are everywhere and just about every selling entity has a 'return policy' and said person can send you a box of rocks and you're out.

It’s a Freight Forwarder, eBay knows this and knows the buyer couldn’t possibly have received anything since it hasn’t been dispatched to their country. eBay knows they could not have possibly returned anything either yet they will play stupid. They will also suggest they never heard of this happening and it’s new to them. Just like how they are handling FF in Doral.

You offer free shipping on some of your shoe listings that I can see active. How can you do that and make a profit and cover selling fees?
Profile says you're in AZ. How can you even make a profit on such listings?
Do you review your buyers' profile before shipping?

You have to do your homework and keep your guard up! This is the internet. Not a garage sale. You have no personal interaction with the buyer.
FedEx? Worse shipping provider along with UPS.
You need to sign up for eBay international shipping program to be protected.

That is the address of ZYGJ Global Inc. which is indeed a freight forwarder. You need to appeal the case you lost again and provide the information related to the freight forwarder and reference eBay's policy on buyers loss of MBG coverage when a FF is used. Without that information there is no way eBay knows this is a freight forwarder.
You didn't receive 4 more orders from this address you received 4 orders from buyers that are using a freight forwarder to ship their items. Hopefully you added the first buyer to your BBL. As for the outstanding orders look at the buyers actual address which you can find in the order information. If they are going to the same place you may want to take some action.
There is nothing wrong with shipping through a FF I have sent a LOT of items that way and never once had a problem. Other than EIS it is probably the safest way you can ship internationally. Curious if the buyers are located in China? A lot of Chinese businesses are filling orders for Russian buyers, having the items sent to China and then forwarding to get around the sanctions.

As you can see from replies, we could have advised you how to win this case if you hadn't already used up your appeals, and now you're probably so deep in doo-doo from all those cancellations that your account may be at risk (depends on what reason you selected for cancelling).
For the life of me, I don't understand why some sellers seem to view the Community as nothing but a dumping ground to come and poop out shock and anger, rather than seek advice while it is still possible to use it.

@sextons-sweet-deals if you have "30 day returns accepted- buyer pays' then ebay has set ALL returns within that time period on 'Automatic' and have done this for about 5 years.
The 'one way' to 'slow' down an 'automatic' is to click 'issue RMA's', now I am asked to a.) confirm 'return address' and b.) issue RMA
For 'Not As Described' everyone is on 'automatic' and the only thing they 'ask' is 'issue label yourself' or 'have ebay issue label', but the rest is ALSO automatic (and if you don't answer, they will do it for you.

EBay has no idea it went to/through a freight forwarder and most of the INR claims are handled by the bots. Unless the seller provides the information showing the address is that of a FF and the item has successfully been delivered to the FF the bot is going to rule in the buyers favor.
If the item went through a FF a seller does not have to accept returns. If they do accept the buyer is responsible for getting the item back to the FF. The seller may need to provide the shipping label from the FF to the seller depending on the reason for the return. It is of NO benefit for a seller to accept a return on an item that goes through a FF.

The OP did not state what the buyer's reason for return was, but if it was an INAD or Arrived Damaged (effectively the same as INAD), then having 'no returns' wouldn't matter regardless of address and regardless of any suspicion the seller might have. There is no 'not accepting' an INAD return. And the kinds of buyers scammers who pull this carp are keenly aware of that, so even if a listing was 'no returns' they just make up a fake INAD reason. Even the requirement of including a photograph doesn't stop them. I just had one and their photograph was a crazy closeup of one of the blue plastic pebbles they sent back instead of the earrings with turquoise cabochons that they bought. I not only won that case but got them NARU'd within minutes of opening the return package.
