EBAY LAWSUIT MC011

At this point I'm beginning a lawsuit with eBay no seller or buyer should ever experience this horrible support. Recently I lose my day time job and began reselling  fulltime with personal and stuff I bought on eBay, as soon as my sales approach 20k I was hit with a MC011 email (November the 6th). I couldn't revise or list anything (please note people were buying stuff from Puerto Rico and asking me to ship to them for free which I do not offer which forced multiple cases). After many research people who get mc011 are people who doesn't ship their product out or drop shippers which I'm neither. After 8 days  (November 14) which i devoted the whole days to solving the issue no one seemed to help me. i have reply to the email countless times saying to reply after you upload your tracking number but after I reply I receive another email saying the email cant receive email. I'm really tired and frustrated as a seller with eBay, eBay only treat buyer nicely but when it comes to seller they treat us like trash. i have been hung up on left on hold for hours and i have experience many chat agents simply leaving the chat, as a seller we should not be treat like this.  Alll my item have been shipped out, every case that happens i simply refund the buyer and tell them that they can keep the item free of charge. i am tried of this and this needs to change

If you don't use your own pictures and descriptions, you need permission from the sites you get them from, to use them.

That is fine and works within the rules.  I know some will tell you there is a problem because you use stock photos, but there really isn't.  Some just assume it means you are drop shipping when it doesn't.  

 

For those that post using a mobile device, Ebay created a photo editing program that allows you to change your pics backgrounds to white.  So some of their pics are getting confused with stock photos too.

 

The reason I was asking was that one of the real sticking points Ebay has and that they are currently really cracking down on is your location stated in listing.  That location is suppose to be the actual location the product is shipping from.  If you deviate from that, it can kick this type of message and response from Ebay that you received.

 

Do you always ship from your location stated in your listings?

Don't worry about stock photos.  That has nothing to do with your issue.

yes my home is the only address i ship from i even got a rollo label printer to make the process easier

Then this is a very odd problem.  Lets call in some reinforcement here to see if they can help you find some answers.  They aren't around on the weekend, so it is likely early next week before one pops in.

 

FYI, I use to drop ship for years.  I only recently stopped.  To me dropshipping isn't a dirty word if the seller does it right.

When you started selling on eBay, you agreed totheir user agreement and their terms of service. 

 

Here is what the eBay user agreement says: 

 

"We reserve the right to refuse, modify, or terminate all or part of our Services to anyone for any reason at our discretion."

 

If your lawsuit is complaining that you have been refused good customer service, refused the ability to appeal, and refused the ability to sell ... well, unfortunately you agreed that eBay has a right to do that.

Simple. Charge actual cost for shipping items that you can't afford to ship for free. As others have pointed out, if you are using flat rate boxes, there is no difference in the prices for shipping to Puerto Rico or California.

 

And no, you can't just refuse not to ship items bought because you don't ship to a location. It will get you banned.

How many cancellations have you filed?

 

How many claims have buyers filed?

 

Have you looked at your Seller Dashboard?  It will tell you if there are any areas that you are not meeting the standards in which Ebay sets forth for sellers.

So sorry  for your frustration and those of others on this board.  However, starting a lawsuit would be futile since you give up all your rights when signing and agreeing to e-bay's contract prior  to selling on THEIR site.

The importance of reading  and re-reading this contract can not be stressed enough and potential sellers need to be aware what they are getting themselves into.  There is a lack of transparency; rules and regulations can be changed at any time, of course, always in e-bay's favor, and sellers will be penalized in more ways than one if they do not tow the mark.  It's all about control and intimidation......so potential sellers.... please.DO YOUR 'DO DILIGENCE'.  Once again, initiating a lawsuit is not an option, however down the road, with enough abuse, a class action lawsuit may be a possibility.

I think that a court might take exception to that clause in the UA if it felt that the entity using it was abusing the privilege, for which they might consider lack of communication, wrong information responses, lack of response, etc., as be part of the problem.  Being in print may mean it is true, but it doesn't always mean that it is legal or acceptable in every real-life situations. 

 

Corporations have responsibilities, as well, to go along with their dictates.

Not saying 'NO' doesn't mean 'YES'.

The foolishness of one's actions or words is determined by the number of witnesses.

Perhaps if Brains were described as an APP, many people would use them more often.

To me it's irresponsible to buy 3 swingsets at $300 each when you're not working.  How big is the shipping box and how much does each weigh?   Do you know the logistics of shipping anything that big?  If you're not drop shipping you'll be in the red.   That is why WalMart does not ship this gigantic item to Puerto Rico.   You could try to break even and sell locally with free set up... also WalMart does take returns...  or you could piece out the sets for replacement parts.

   

When you get this situation cleared up start selling smaller items and don't rely on free shipping.  When you insert the box size and weight into a listing the shipping can be automatically calculated to appear in the listing for every potential buyer's zipcode.   Every device has a zipcode assigned to it.  Buyers closer to you usually have cheaper shipping which is a selling advantage.

 

Selling on eBay is not easy work.  You can't just sit in front of a screen and make a few selections.  It can be back breaking with hours of dedicated work and attention to detail.
