Dishonest chargeback

Have a buyer buy a $1000 rifle scope, requested a return, and I accepted. He furnished his own label through eBay, and sent it off. It made it all the way to my city, minus the final delivery scan. Item is nowhere to be found.

 

He opens a case, and during eBays investigation, he files a chargeback, closing the case and leaving only his bank as the decider. He also leaves negative feedback like a true **bleep**, eBay removed it though.

 

Per eBays policy, I am not responsible for the loss since I didn't furnish the label. He is. Knowing this, I think he then filed a chargeback.

 

I sent my proof of non-delivery, chat transcripts with eBay stating HE is at fault, as well as eBays policy on the matter. Its been a few weeks and his bank is still deciding I guess.

 

Since eBay is out of the equation, do you think my bank will offer some sort of protection even though they don't necessarily abide by eBays policy themselves?

 

I am just asking before I call them tomorrow, they are closed now so I figured I'd just get some opinions in the meantime.

No, it goes to your MP account first.  

 

You can report it as "fraud" to whom?

 

If you "fail" what?  According to you, you have your money, what more is it that you want?

It isn't deem lost by USPS until it has no movement for 30+ days.  The OP has called the package lost, but I've asked and they haven't answered yet, has USPS deemed it lost or are they just assuming that.

That is fine, it however doesn't change anything.  Whomever pays for the label is responsible for the package.  Like when we [sellers] are responsible for the package until it is received by the buyer.  If the buyer purchases the return label, they are responsible for the package until it is received by the seller.

As a Seller the OP nor any other seller on this site has the ability to leave negative feedback.

 

The negatives you are seeing on their Feedback Left For Others would be when they bought something.  They were the buyer not the seller on those transactions.

      Good question on the deeming of it being lost OP didn't provide timeline on the return shipping nor did he indicate whether he has filed anything with USPS or whomever the carrier was/is.  As for filing the lost mail/package request following are the timelines for filing either a lost package claim or an insurance claim with USPS. I have only had a couple items lost but I generally bypass doing the lost package search and simply file an insurance claim with USPS.

In my experience, USPS will not do a thing about determining a package lost until 30+ days after the last scan.

 

With that said, it really doesn't matter.  The OP got their money back.  The claim was ruled to be covered by Seller Protection by Ebay.

 

I have no idea why the OP is dragging this out or has a need to be in contact with the CCC / Chargeback.  This matter is really closed, but for whatever reason the OP has, it is not closed to them.

In my experience, USPS will not do a thing about determining a package lost until 30+ days after the last scan.

 

     Sorry your support from USPS has not been as good as what I have received. I have filed within the timelines as soon as the package exceeded the delivery date and had not shown any movement, regardless of the number of days it had been since the last scan. I generally had a response back from USPS within 3-4 business days and the case closed out and resolved in under 30 days from the time I filed the claim. This includes getting the check from USPS.

Why is this so hard for you to understand? If I lost the chargeback, where does the $1000 come from when he gets his refund? Thin air? Its in my bank, and will be pulled out if I lose. That's something you dont seem to understand. Ebay does not have my money.

I will report it as fraud to my bank. Please try using your brain for once. 

 

What more do I want? If his chargeback is successful the money gets pulled out of my checking account in a fraudulent manner.

OP: This is a perfect example of CS not knowing their tail from their nose. Even eBay isn’t in contact with the buyers financial institution, it’s all through MP…


While I totally agree, the copy of that transcript may go a long way towards holding eBay accountable on appeal should the CCCB be found in buyer's favour. I would most certainly be using it and making a LOT of noise.

 

It is far past time eBay did something about the so called CS, and let's call it what it is - cheap labour

I would give it a little more time before opening a case with your bank. I've been in a similar situation, and the buyer's bank took a few weeks to finally issue a decision. However, you are protected from loss when the buyer issues a chargeback. So if their bank sides with them, eBay will issue you the money that was "lost".

They would pull it from your MP account, which if it goes negative, MP would look to your attached bank account to cover whatever your negative balance is.  But again, your bank has NO access to the Chargeback and will not even know it has taken place.

 

But earlier in the thread you said that Ebay said you were covered under Seller Protection and released the hold on your funds in MP.  Has something changed?

 

Did Ebay decide you were not covered by Seller Protection?

There is no need to be rude.  I have not been rude to you.  It is completely unnecessary.

 

If MP ends up pulling money from your attached checking account to cover a negative balance in your MP account, if you report that as fraud, you are NOT reporting the Chargeback as being fraud, you will be reporting MP pulling from your checking account as being fraud.  Again, your bank has nothing at all to do with the actual Chargeback and they know nothing about it.
