With Pokemon going crazy at the moment I figured now would be a good time to get some extra cash before Christmas.
I sold a Sealed Booster box. The buyer paid with Paypal.
I shipped it express post with insurance.
The buyer has now just sent me a video of him opening the box (not of him cutting the plastic seal, just opening the cardboard box) and inside is two cans of Tuna instead of booster packs.
He has made a complaint saying the product is not what I claimed it was.
I've called eBay and created a case file for it. I've spoken to Paypal and also created a case file for this issue.
What do you think the chances of me getting this issue resolved? I understand that eBay prefers to side with the buyers.
Any advice of what to do next would be much appreciated.
is it 2021 yet? these years been rough

The booster box came out of a case of 6. I've opened 1 back in 2015 with no tuna inside 😛

Classic return fraud scam. It's sad but ebay is well known as a place where you can get stuff for free. Only sell low value items you can afford to lose. You can and should report that buyer. Too many such reports and ebay will take action. However, be then a lot of seller have lost a lot of money.

Perhaps not, but it's ALL you can do. No international returns and a CLEAR policy. At some point down the road these anti-seller policies will be problematic for eBay. Meaning that either there will be some lawsuit or congressional investigation of some sort. We've kinda seen the attack on Bezo/AMZ. Who's to say what the future will hold? While I wish no ill will on eBay, I know there are plenty of sellers getting tired of being stolen from. No "good thing" lasts forever. Who knows what records sellers are keeping or who their friends in high places may be?
One thing is for sure, politicians and lawyers love to stir the hornets nest. Sometimes the hornets sting you, sometimes they get drowned in the lake.
What can make this more problematic is the amount of, ehh, less than wealthy people who sell here to make ends meat. Get enough of them screaming about it, in tandem with the, err, scandle that has happened, and who knows what could happen. Political winds shift quickly and sometime things make new stories to keep the news "interesting". This incident hasn't even been settled. You never know how ugly things could end up getting.

You will want to present your evidence in an appeal after the case is closed in the buyer’s favor. During the appeal, your data will be reviewed by an actual person. It is said that the initial case is not reviewed. Below is a link on how to appeal. Good luck to you and very sorry this happened to you. It is devastating.

I'm hoping that the weight of the tuna cans vs the weight of the package is enough of a discrepancy for me to sway eBay.
And this is EXACTLY why eBay does not accept video evidence from buyers OR sellers. And yet seller after seller will vociferously recommend taking a video of packing and shipping an item--and get really belligerent when they're told that eBay doesn't look at video "evidence." I haven't noticed buyers posting about it quite so much.

I agree with you that the likelihood of a positive outcome from filing all these charges etc is rather slim. BUT, that should not be an excuse NOT to do it with scammers like this. The “CARDS” will stack up with people doing this here, and soon, they will be ingesting their TUNA, for it, and “Charlie” will say, “Well Done”.

Ebay is well aware of the types of items that are extremely scam ridden, hence the authenticity programs they have started. This may be the wave of the future for all websites with items that attract these types of buyers on the internet.

No matter what happens. I hope the replies from all these wonderful posters have helped ease you pain and stress a bit. Best wishes, and know you are not alone with this problem. If you have been on this website for any amount of time you will encounter some really bad buyers. It’s just the luck of the draw some times. Just be careful next time on what you choose to sell.

Yeah, I often thought about that. It’s one way to increase your profits and decrease your losses here. Actually , I wonder what the statistics would be on stuff like that from buyers and sellers, becuase it’s jurists way too easy to do it here.

Years ago, on another account we had, we went through this. We let this scammer buyer know that we were going to persue every legal avenue, including filing police reports, internet reports, etc. Within TWO HOURS he responded that he was very sorry that he didn't want any trouble and had lost his job, etc...
Let this person know you will file reports and for him or her to be ready to answer anything the investigators my ask..
In our case, the scammer actually gave us our money and CD back.
