We recently had three item not as described cases opened on orders made by 0 feedback freight forwarder buyers sending orders to Chinese forwarding companies. The following ensued:

Is this correct that MBG is still valid for forwarders as long as they use the Ebay provided return label? I'm surprised Ebay didn't include this note when mentioning on the exclusions list or reworded the excerpt above. We opened up forwarding orders after reviewing the FAQ but it looks like we're mistaken, and based on what I've seen other sellers recommend per this FAQ, many of you are also mistaken.

Your belief of legal culpability is an opinion. I'll provide an example: If a buyer ships to a freight forwarding company that is easily researched by address and clearly states they ship to X country, buyer profile states location is in X country (this may not even be needed), and the item you sold is restricted for X country. If you still choose to ship this item, you can be found liable as the initial shipper for failing to conduct due diligence. Again, it really gets more complicated than that. If you are actually interested in learning more you can search BIS "Knowledge" provisions. You can contact courier experts and also contact BIS directly, as they ask you to do, when you are unsure. Let's refrain from making blanket and absolute statements that do not apply to everyone.
But based on this thread, if we follow ebay community member clarifications on FF shipments and cancellation, we should be shipping this order. Or this may legitimately fall under address issue.

Buyers don't ship to the Freight Forwarder, Sellers do. It is unlikely that the FF will disclose the records to the seller as to where the item is being shipped. There is no rule that says the buyer will always have the item shipped to the country in which their account is set up in. That is an assumption. The seller has nothing to do with the address the package ultimately gets shipped to nor is the seller even consulted.
The seller doesn't retain ownership of the item once it is delivered to the Freight Forwarder as far as I know. Nor does the seller have any control over where the FF reships the item to.

Well, I just had a buyer, with no prior contact to me, open up a chargeback with their credit card company for a beautiful vintage pin that was delivered to the address they supplied, 261 Quigley Ave in New Castle, Delaware. When I checked the buyer, they show their residence as China. I provided proof of delivery to ebay to forward to the bank before I checked and saw that she lived in China and that the address in Delware was probably a freight forwarding company. No way to amend what I sent to point this out. Honestly, This will cause me to cancel such sales if I am out my 35.00.

Whenever I see a suspected FF on a shipping label, I google to confirm. Then, I message the buyer to inform them of ebay's FF shipping/MBG policies. Then, I ask them to confirm that they still want me to ship through their chosen forward shipper.
This may not be practical for high volume sellers, but works for me.
