Counterfeit Items

I recently purchased some Giveaway PROMO bags from a seller on Ebay to resell.  I was flagged that the items were counterfeit.  I argueed the case and my item was reinstated.  Only to be flagged again...however the entire time the person that sold me the bags was still selling.  How is it ok for me to purchase the bags however I can't sell them...makes no sense and what I'm told by Ebay makes to sense either.

For sure..the future of American sellers  on Ebay obviousy doesnt matter.They have made it as tough for us as they possibly could..that doesnt happen with the Chinese sellers.

That has to be what it is.  Is the seller from china?  If so there is your answer .  There allowed to sell counterfeit and we are not.  Although most US sellers dont want anything to do with counterfeits from china anyway as far as we are concerned they can keep it right were it is over there.  But oh no that wont work they need to saturate our market with this stuff.  Best reagrds

You can try reporting that seller's listing. It does sound as though they reported yours. I wouldn't try relisting  the item again. Next time could be your last.

Even if they have no IP rights being "violated"  in China, they SHOULD be forced to follow US rules when listing on a US site.

 

"It's ok in China" is a pretty lame excuse for a venue to allow counterfeits to be listed by offshore sellers.


US law is controlling, it doesn't matter if something is lawful in a foreign jurisdiction.

It takes one minute to find out how many fakes items, and sellers not authorized to sell something are here on Ebay. The problem is that it's "me" who is told to stop selling them. What a lucky guy we are. Smiley Very Happy

I agree, but the problem is also with those who buy.  Many buy because they don't care if the item is counterfeit or not, they just want something that looks like the real thing at a fraction of the cost, and they are happy with that.

First-- Don't try to resell those bags here.

 

Second-- Since eBay agrees the bags are counterfeit open an Item Not As Described dispute with eBay if you are still within the MBG 30 day window.

If you are not you could go to Paypal which has a 180 days window, but PP insists that the buyer pay for tracked return shipping before refunding, and if as many guess, the seller is in China, that could be very expensive.

 

But you also are covered by the credit card you use to back your PP account. Card policies on chargebacks vary, so you will have to call them from the number on the back of the card or on your invoice.

eBay's MBG has expired.

Paypal allows six months from payment.

May still be time to open a Dispute there.

And possibly even a credit card chargeback if he is smart enough to back his PP with a card.

 

EBay is not the end of Buyer Protection, much as it dismays some sellers.
