CA Prop 65 Warning - Are there any sellers using the warnings on their listings already?

As a business where we sell Upholstery Fabrics and Vinyls, we are trying to gear up for the new CA Prop 65 warning that goes into effect on August 30th.  Are there any sellers that already have the warnings in place on their listings already?  I would like to see what other sellers are doing to preparte for this new requirement.  In actuality I would like to eliminate selling to CA altogether to avoid the headache but seeing as how we can not eliminate CA, I guess we need to do what we have to do.  Any input and/or feedback is much appreciated.

My business will not have to comply.  Per the official website on the frequently asked questions for businesses page, it states businesses with less then 10 employees are exempt.

Yes, businesses with less than 10 employees are exempt. This is the case for my personal selling account, but not for our business which has over 35 employees.

Are sellers required to name the chemical in the listing?

 

We sell vintage items that are often used so we won't necessarily know the materials used to produce our items. We talked about doing a blanket warning statement but want to be sure to cover our bums as much as possible.

Better safe then sorry. The only problem with putting these warnings on the listings is that people in other states may worry about it and it could cause a drop in sales!

I was inclined to add the warning "just in case," but only people who are familiar with California would understand that California over-reacts. As you point out, buyers in other states might be scared away.

Gotta love CA! So many times they are the first to cause panic and uproar over nothing.  But really alot of our sales for the business and my personal account come from CA residents so I can't say too much bad about them.

From what we understand as a business,, it does cover the packing materials you use to ship to CA.  We purchase large bags for the company and because they are already in place we can use them without a warning, but going forwards, it is our understanding that we will have to have a warning on the plastic bags as well.  This new law is causing a lot of extra time/money for our business.

It is our understanding that if there are any cancer causing or birth defect chemicals used in the production process, then at least one of the names must be present in the warning.  If you take a look at my vinyl listings, I have added the warning and one chemical name is shown that is present in them.

Not sure it applies to you...but if your business has less then 10 employees, you are supposed to be exempt...but don't hold me to that...just going by hearsay from the folks here and other sellers.

California also leads the way for other forward-thinking, progessive states and countries, enacting legislation that protects the environment, air and water quality.  I'm a Californian, and though the state is far from perfect, I take pride in the state being a leader of green technology, and protecting our environment.  I'm perfectly fine having laws that protect people from doing what they do best...think of themselves first, and everyone else and everything else be damned.

Yep we have the best here. We are experts at tax and squander, have the highest poverty rate in the nation, the worst schools in the nation, and the biggest spread between wealth and poverty. But we are leaders in clean water spending. Every year California has a "clean water" proposition or bond on the ballot. Every year it passes because those who write the measures know how to title them. I read all such ballot measures from beginning to end. I have to say that most of them contain nothing of substance in regard to clean air or water. The majority of them are for property acquisition, park and facilities improvements, visitor serving centers, staffing, and similar expenditures that might somehow be ancillary to "clean water". The monies that are collected, often as bonds, are then used as "grants" to fund interesting private sector projects that, by necessity, must include the words "to improve water quality".  As in "This $195,000 project will replace a quarter mile of eroded road that will be constructed farther away from the riparian habitat in order to avoid further erosion and toxic runoff into the creek, improving water quality for the endangered native salmonids during their most vulnerable period." And voila, I've got a new engineered and paved driveway at taxpayer expense, as long as I am a progressive thinker who knows how to write grant documents and use the best adjectives.

I've been a California resident for 65+ years and have to say that, IMHO, lately this state has passed some of the stupidest laws and initiatives in human history. 

 

If we didn't own our house and the weather in our area wasn't so good, I'd move out of this stewing swamp of political correctness, high taxes, and overwhelming government regulation.
