Buyer wants to return used item. What are my rights?

Basically, I sold a used projector and had pictures on the listing to show people what they get. So it got purchased and I sent it. The buyer has received it and says that its missing legs to tilt the projector on a table and therefore, saying that it's not in working order. That's not true because the projector works 100%. The projector is sold as is and I never advertised it to have legs or not have legs.... nor was I aware of the legs to be honest as I always had it mounted on the ceiling. I didn't comment on the legs at all. The buyer assumed that it came with legs. It might have when it was brand new, but we have had it for a few years and really don't know where these legs are, if they did exist. 

Anyways, what are my rights in this situation?

You might have sold a wall mounted projector - thus, no legs. If the buyer thought it was a standard projector then I can see the problem with thinking there were adjustable legs. So, it is probably just a misunderstanding.

If the buyer opens a "item not as described" claim (whether it works or not) they will be sent a shipping label for its return to you - so, in that case, you really don't have any "rights" per se. When you receive the prjector back, issue a refund. 

Relist it stating it was wall-mounted and has no legs. Sorry this happened but it's best just to have them return it and move on. 🙂

If the buyer has filed an INAD and you want it returned before refunding, accept the return and provide return shipping.

On eBay, essentially your rights are to accept the return or if the buyer escalates it to significantly not as described case, eBay will force the issue.  They will require you to provide a shipping label at your expense and if you don't, they will refund the buyer from your account and not require a return.  

Your best bet is to accept the return and refund when you get it back.  

Oh and before you say that your listing had "no returns accepted" as your return policy, eBay's money back guarantee over-rides your policy.  All "no returns" means is that the buyer doesn't have to return it, but you sill have to refund.

Basically sellers have no "rights" buyers rule eBay.

 Thanks for your help, guys. We will thoroughly search for these legs on the off chance they're somewhere around the house and we'll send it to him. If we can't find them, we'll ask the buyer to send it back to us and we'll re-list as a leg-less projector lol.

Alas, you must have another account as the projector does not show up on the account you are posting with here.  So speculating a bit, all projectors have small legs to help aim up from a table to a screen.  Without the legs the projectors do become somewhat awkward to use.  You could offer a partial refund.  I would make it a substantial refund.  Otherwise, given the cost of shipping a typical projector, you are probably better off just abandoning the item with the buyer and moving on. 

 

As for your "rights", you have none.

When you sell an item on eBay, it expected to be compete and in working order with any defects or missing parts noted.

 

If you do not know whether it originally had legs, then you do not know whether your listing was accurate or not.

 

That aside ...

 

eBay does not know whether your listing was accurate or not either.

 

So they will side with the buyer.
