While eBay luckily closed the return case as they saw they listed the item they bought from me using stolen photos, I've reported the listing 3 times now, attached the above photo, and they still won't take it down.
I put in the final report message:
Please take the time to view the photo of my listing and the photo of my buyer's listing, which I've attached for convenience, which shows both user ID's, compare the reflections and shadows and see this is the same exact image. These photos are photos I took and are my own intellectual property, under express copyright and I forbid anyone else from using them. Please read the policy "Images, text, and video" and find that it is against eBay's own policy to use someone's photos without permission, which I do NOT grant to anyone.
Not 2 minutes later: "We looked into your report and didn’t find the listing to be in violation of our policy. This determination was made by a customer service agent. "
Um, what? Is the ghost of Ray Charles working for eBay now?

The images can be used by other sellers.......

When you create listings you give eBay and its customers permission, through our User Agreement, to use your images, videos and product details. Your content may be added to the eBay product catalog, and may be used by other sellers in their eBay listings.
You may contact the seller and ask them to remove your image or text if it is not part of the eBay product catalog.

Why don't you show us where that is, please? Pretty sure you cannot as it not correct.

I’m actually surprised they would close a return because they listed it, but using photos from other sellers is pretty common, so doubtful anything will be done because of that.
