Hi, I had a buyer, open a return. They never used the return label and never shipped the item back. However,
somehow on the final day that was allowed for the buyer to ship the item back, instead of closing in my favor. Ebay bots automatically closed the case in the buyers favor and refunded them.
I immediately called into ebay and they saw the mistake ,, and did give me back the money"as a courtesy". however, the buyer still has the handbag.
I am livid, this buyer was beyond rude. The handbag was in pristine condition and I take very clear pictures and answered all questions. The buyer literally took a picture of the inside pocket of the handbag where there was a small sliver of napkin and said it wasn't pristine. blah blah
anyway,, I know I have my money back, but it's the principal. I called the buyer. As soon as I announced who I was, she hung up. Then I sent an email through ebay and informed her that she was incorrectly refunded. She needs to return the purse or resubmit payment.( I also called ebay and told them I was doing this, and once I got an answer, i would contact them, and if necessary, give them back the money(if she did return the bag))\
The buyer then emailed me, and said, she got off the phone with ebay and they said that ebay had made a mistake in the refund, however, they did give the seller their money. So she doesn't have to return it. I call **bleep**.
I emailed her and told her, the merchandise was not ebay's to give. I told her that she has merchandise that she did not pay for . Therfore if she doesn't return it. I'm planning on calling her local police department and filing theft charges. Can anyone give me advise on how to proceed.. I know I should just let it go. However, I'm SICK AND TIRED OF A SMALL SUBSET OF BUYERS GAMING THE SYSTEM...
she lives in a small town.. (3500-4000 people).. I may not get the bag back, but im not going to sit back and do nothing, does anyone have any experience with filing a report at a buyers local police office..etc..
any help would be appreciated.

...and if you let each and every one bother you like this...make you do irrational things like this, you won't be selling on ebay for very long

You have been refunded the money. You can't expect to get the item and the money too. I'm not sure what your complaint is, but you have been made whole.
Reporting this to her local police department and claiming theft when you have the money is not going to work.

Fwiw, I don't understand why the OP is getting bashed? It was eBay's mistake and this isn't the first time the issue has come up on the board. Not exactly confidence inspiring if "the system" is so tilted that it has no way to determine if a return shipment has actually been made & delivered prior to a refund. Apparently not, or these stories wouldn't keep popping up. The seller had the hassle and stress of then getting the mistake fixed and probably will soon have to fight hard to remove a defect that will probably show up. And it's his / her fault for being angry and then gets the typical fisking? Please.

You might search around for the moral police, but not the criminal police, since there is no crime. It might even open you up to actual prosecution for filing a false report on someone. There is nothing to put on her record.
You just want to "win", but there is nothing here to fight for, since ebay settled the issue.

I do absolutely agree that ebay should remove a defect for unresolved by seller case if one was issued in this situation.

if a buyer opens a return , but fails to return the item, it's counted as a strike on a sellers metric measurement.
If you filed and won an appeal (or eBay did so on your behalf), no you don’t get a defect. They say it directly in the message to you saying that you won an appeal. If the refund to you wasn’t processed as an appeal, call back in and have that completed.
