Buyer wrote down for reason "The item doesn't match the description in your list" However, on buyer notes, the buyer wrote down "Item not received" I checked the tracking and the tracking states they received the item on July 7th. They purchased the item on June 28th.
Is this a winnable dispute if I challenge it or am I better off just calling it a loss? I ask this because usually if they put item not received I can prove it with tracking. But they put down item doesn't match description and then on buyer notes put down that they never received the item.

Ignore the comment. eBay handles the payment dispute according to its type @elhoardo not the comment.
Is there a return address down the left? If so, eBay will require a return first.
But if it's not there, you will lose the $20 bet with eBay if you challenge the payment dispute.

Here is the latest from eBay on chargebacks.
https://www.ebay.com/sellercenter/resources/seller-updates/2023-summer/business
I believe you can upload several files now.
Let us know how this works out.
If the payment dispute screen is different that what @qeqo_0 posted, please post a screen shot.

In general it is not winnable. Not to mention a $20 charge if you lose the dispute. It really comes down to the value of the item and whether it is worth the time and risk to dispute the chargeback.

Best to go with the having the item returned.

Did this buyer even try to start a return case with you. If not they bypassed the proper ebay proceedures and went straight to their chargecard. That generally is a no no. Customer is suppose to work with merchant first. Merchant being ebay NOT YOU. HAVE THEM TRY TO GET THE ITEM RETURNED TO YOU IF POSSIBLE.

Block the buyer and just consider it a bad sale. Nothing you can do...it would be a waste of time.

The other questions is. Did you have it on your listing that you accept returns. It’s a risk with people who then do a chargeback instead of just filing for a return request on here. My advice. Accept returns or you may be dealing with this again soon.

On all of the payment disputes I received, I can't recall an area where the buyer was able to leave a note of any kind. I also just checked the details page of my most recent six payment disputes received and none of them have "buyer notes" where the buyer was able to type a comment. All I see is a field where the buyer was able to choose a dispute reason, I assume this area is a pre-filled choice.
Where are you seeing your "buyer notes"? Can you provide a screen shot? Just asking to make sure we are on the same page and what you received is an actual payment dispute.

That is a good point about noting the return policy if you contest the chargeback.
I just won a chargeback on AMZ. They never even said what the reason was for the chargeback. Nada.
All they said was to present my case and include my return policy. No uploaded documents were allowed, just text.
It was a $255 transaction that was delivered by UPS.
My basic response was:
Ordered on date
Shipped on date
Received on date, and signed for by Headspeth
Return policy was 30 Days, same as AMZ.
And they asked for return address.
It was not even a signature required delivery. Just happened to have the name in the tracking.
Took 2 months for a decision. Winner winner....
I lost the last one for like $72.

On a related note, I have never won any payment dispute that used the "not as described" reason. I can't remember if I tried to fight any of them though. Nor have I ever received the item back despite me choosing that option for them to try and retrieve it for me.

That's because PayPal has now dropped a hard line on eBay payment disputes, finally putting an end to all the scams with buyer returns.
When the seller provides their name and return address to a payment dispute, eBay replaces the seller's name with "eBay" in the return address "The item has to be sent to the following shipping address" which guarantees that the return will never be delivered.
PayPal even requires a copy of the actual return label "we may ask you to provide this document later" to facilitate the return of a bauble to another address in the same zip code.
Then PayPal requires that "Once we've confirmed that eBay has received the item(s)" so that the seller actually looks over the returned item before allowing PayPal to "we'll issue the refund and close this case."
It's a much better attitude, as the seller must actually confirm that they got their item back, or may never have to refund if the buyer cannot prove or waits too long to return the real item.

That type of claim is called a Chargeback. You should ALWAYS try to win. But to even have a chance, you have to submit evidence. You will find a way to do that on the Chargeback. You will want to submit the tracking and you want to submit what the buyer wrote. You should highlight it too so they don't overlook it.
You can copy it into a program like Microsoft Word and highlight what you need or you may know of other ways to accomplish it.
You certainly have the right to say you don't want to bother with doing that and just lose the money, pay the $20 fee for losing the chargeback and you do not get refunded the FVFs even though the sale was refunded. It is always your choice.
I wish you well in whatever you decide to do.

Ignore the naysayers. I have won item not as described payment dispute for an item over $1200 that went international.
Also the payment dispute process is now much different as someone else pointed out.
I recently had a dispute opened about a week ago, (I made a post about it if you search my posts)
Now when you contest the dispute, and provide good details and such, you get a screen that says you are automatically protected.
i am attaching that screen
i recommend using CHATGPT to write the 1000 word text, and use the 5 screenshots to show all evidence (especially if you offered returns and they neve did)

Was that claim for an INR? Was it filed in Ebay or did the buyer go directly to their Credit Card Company and file a dispute?
