Buyer did not read title or description

So I sold my first item and it was an amazing feeling. Today the first item got delivered and now the buyer says it is not as described. 

The only thing is I wrote in the title that what I sold did not come with anything else and it was also mentioned (in big letters and underlined) that what he ALSO wanted along with the main item are available and will be sold separately. 

 

He said that he expected everything else to be included and now is fighting me because “box” and “charms” was in the title. The full title is “Iconic Silver Charm Bracelet Pandra Size 7.5 PREOWNED w/o box and charms”

with this in the description: Original bracelet box and charms are available and I am selling them separately

 

 

I spoke with ebay and they said they would give him the case because he is claiming its not as described, but if I file for an appeal it will be in my favor.

 

what do you all recommend me to do?

I was really hoping my first sell would go smoothly:(

Congratulations on your first sale!  I understand you hoped your first SALE would go smoothly, but things happen.  

 

Here's what went wrong.  The picture on that listings SHOWS a box and charms along with what you are actually selling, so it is a SNAD.  The listing pictures does not coincide with your title and description.

 

NEVER picture something that is not for sale in a listing.  Many buy on their phones and just buy from that picture~and he may have missed the W/O in the title and focused on box and charms, or even not known what W/O means.

 

WITHOUT might have served you better, but still, there is a discrepancy between picture and listing.

It's best not to put anything in the picture that does not come with the item you are selling.  It confuses the buyer. Even though you put it in the description and title that those weren't included, Ebay will make you refund the buyer.   You'll have to chalk this one up as experience.

You accept the case, send the buyer a label (you pay for return shipping), to get your item back.  Given the picture, I don't think an appeal will help you, but they might give you a courtesy refund of that shipping since you are new.  I don't know.

 

If you don't want the item back, you choose refund.

 

If you want the item back, you choose return for refund.

 

This falls under the MBG, get the item you ordered or your money back and it overrides any no returns policy you may have.

I see no reason why "filing for an appeal" is going to change anything. That Customer Service rep has a vivid imagination.

 

Get it back for a full refund, so that you can relist it without showing items that are not included, and recoup at least some of your investment that way. You do not have to refund before getting the item back, though you will have to cover the buyer's return shipping. 

 

In future, you really need to show and describe only what is for sale, and not show something in photos that's taken away in text. I have to admit that when I read the title in your original listing, I knew from the post here that the issue would be about the box, but it wasn't until I read the disclaimer in your text that I learned that the charms, which you'd shown in no fewer than four photos, including closeups, were not included either.

I certainly hope the buyer sends back the item in good faith, most likely they will however your listing states that you do not accept returns and that means the buyer can still get a refund through the Money Back Guarantee whether the item is returned or not.

Had something similar happen to me where I had an item where I had several quantity, being sold individually.  My picture showed 2, front view and back view because at the time it was taking forever to download pictures and complete my listings.  One customer commented that item was fine, but he thought he would get 2 like the picture.  He didn't ask for anything else, so I lucked out there.  I went into the listing and cut out the other item.  Now I just take pictures of each side and post separately.  Just waiting for the day when someone complains that they did not get the penny, quarter or ruler pictured with item to show scale.

OMG thats what I was telling my brother right now! 

Like did he want the measuring tape? The white board in the back?!

I have seen people post crazy amount of things in the back...and I would never assume I would get the rest. People don’t read now a days. I was so annoyed. 

 

Prayers for you and me to avoid buyers like that😒

Trying to equate the measuring tape and white board to the item box and charms shown in your photo is only trying to justify your mistake by blaming others.

This is more, or less a false dtatement. . If the buyer open a SNAD(which this buyer did) they must return the item for a refund when the sellers accepts.

This is more, or less a false statement.

 

If the buyer opens a SNAD( which the buyer did) and the seller accepts the return, the item must be returned to get a refund.

 

If the seller refuses, that is when the MBG kicks in, and eBay may then not require a return.
