Buyer changing agreement after payment

So here a strange one, Today I put up my iPhone 6s on ebay to sell,I advertised that the phone is locked to att still and can only be used on att. A buyer contacted me asking questions (He has an established account since 2008 and good feedback) the buyer was asking if I could send over the SN so he can check with apple if it had apple care,I didnt send it over but I gave him the proof its still covered under apple care and I told him I would only send him the SN and IMEI once the item is paid for,He immediately paid for it and asked for the IMEI which I provided. He then asked me how much longer the line was in contract for which I told him its about 6 months and he said he was fine with that as he had att as well. Well just a few minutes ago the buyer is now saying he wants to pay off the iphone on my att account so he can unlock it. What do I do now? I can cancel it however he now has the IMEI and SN of the phone now. I have never had this happen to me out of the hundreds of sales ive had. Thanks for any insight!

Whoops I ment to say the buyer wants ME to pay off the remainer of the contract from att so he can unlock the phone.

Ate they contacting you via eBay Messages or regular email?

Neither buyer nor seller can demand a change in the terms of the transaction after the sale. I am not sure of the amount of money it would take to end your contract with ATT, but i think such a request is inappropriate. What also concerns me is the high-scam status of smartphones here. I cannot imagine why he thinks you should buy out your contract when the listing clearly states the phone is locked to ATT and you informed him of the status. Is he a new buyer?

O Trust me I am extremly alert when selling phones online. His account has been opened since 2008 and has a feedback of 80 so I would think that is a good standing account. 

 

I had this listing in big bold red letters stating that the phone is for ATT only, He even asked me if it was unlocked and I said no. He said it was compltlely fine and that he had att as well. I did contact ebay and the guy I spoke with couldnt help but laugh at the situation saying he couldnt beleive what he was reading. He said he "Spoke to a supervisor" and told me to just ship the phone even if the buyer requested to cancel the order since I already sent the buyer the SN and IMEI. The rep said if the buyer files any case that they will be able to see the notes and messages that was sent and automatically close it in my favor? Whats the chances of that happening? Im torn,In one way if I just cancel the transaction I risk the buyer killling my phone since he already has the IMEI and SN,or if I continue and send the item I risk him files an Item not describe,even thought the rep told me they would side in my favor? Anyone has any clue what to do lol

Ooooo, don't agree with what the CS rep told you. You most assuredly should not ship if the buyer requests to cancel. It is rarely in your best interests to force a sale on a buyer who wants to back out. At least under normal circumstances. But I am unfamiliar with what can be done with the SN and IEMI--he could sabotage the phone in some way?

 

My main concern with the situation is that he wants you to unlock the phone, hoping you will do so, and then after he receives it, he claims it's Not As Described and has a practically new now-unlocked phone and he's out nothing. I see you have selected No Returns on this sale. He might try to take advantage of that position in hopes of getting both the phone and the refund. It has been known to happen. I'm not a gloom and doom kinda person, I rarely believe transactions will sour, but this one has me worried.

 

As for the rep saying the case will go your way should the buyer open one, well, it rarely goes the seller's way. The rep says there are notes on your file but did he give you a case number? I always take what the reps say with a grain of salt. Automatically find in your favor? I doubt it. Actually, your best defense would be to accept returns--if a buyer claims a deficit of some kind, all you need to say is "Return for refund." But if your buyer isn't on the up and up, and he really wants this phone, all he has to do is send back an empty box to force ebay into giving him a refund if you won't. And you'll pay for the return shipping if he opens the SNAD case. Like i said, he'll be out nothing, especially if he could persuade you to unlock the phone. I sincerely hope i am wrong about your buyer.

Dumb question as I don't and never had a cell phone.

 

Does the OP contract have to be paid off before the buyer can even use the phone with ATT?

See thats what I was afraid of. Yes with him having the SN and IMEI he could potentially clone that infomation to a phone that is reported stolen and now leave my phone as a paperweight. Yes I do have a case number. The rep said even if the buyer says something is wrong and opens a case that ebay can go into the messages and see how he started to change the deal and close the case. I really want to just cancel and refund just to avoid the hassle but im terrified of him deacvtivating the phone.

No, If the phone is under contract it can only be used on that carrier (ATT) now once the phone is paid off,you can go to a website on att and unlock the phone.

So I just spopke to a supervisor in  trust and safety and she told me to ship the item since the buyer already paid, She agreed that since the buyer already has the IMEI and SN that if I cancel the transaction they buyer could potenetially render my phone useless. She then went on saying that the messages that have been sent back and forth between me and the buyer should be more than enough to close the case in my favor if one is opened.  She did leave notes and I did get a case number.
