BD Multimedia/Red Point Solutions attacking me with bots once again

This morning I wake up to a vero notice that read once again,

We had to remove your listing because it didn’t follow our VeRO Brand Name Misuse Policy. You may not use brands names in your listings if the product isn’t manufactured by or compatible with that brand

 

How can ebay continue to allow 3rd party agents to use bots to auto flag listings?   Don't tell me they're just complying.  This is illegal for someone to file such a false claim.  It's also a site disruption.  It obviously does no good to call a call center,  nor did it do any good to contact ebay on facebook or vero. I already proved to this 3rd party hack that I purchased the good directly from the manufacturer but bots don't know that,  nor do they know the item is no longer manufactured.  This is abuse,  nothing but purely wicked abuse.  They know how much it would cost for someone to sue them so they abuse the system by using bots.  This message board is full of complaints about them but ebay does nothing to remind them filing a false claim is not only against the law but is also against ebay rules.

I would try to change the title. Usually the title is what they pickup on. Is there a key word they are picking up on? Maybe pull the brand name in the Title, but make sure it's on the description. Or even put as your first picture the title of the item.  I received a Vero claim for using Velcro in the title. I changed to Hook and Latch and sold the shoes.

The title is what customers will be looking for. The company uses bots and an algorithm to auto flag titles that don't match their client's catalog. The shoe I was selling is no longer manufactured.  They know this because I told them before.  They're not lawyers,  they're the equivalent of a collection agency harassing people. Selling these things is hard enough without being harassed all the time.

You can get very creative with a title and people will still see it in search. I see stuff with Titles literally just "Electric Guitar" or "Mens Sterling Silver Ring" and they sell no problem. You may, if you already haven't, want to start a Instagram page for advertising sales. You can hashtag the hell out the item with a picture of your Ebay Sale that will bring them to your Ebay account even with a basic title. Try it.

Vero can send a takedown notice at midnight on Memorial Day?  Yes they can't answer my email?   What id they have to do?   Call up a lawyer for advice?

  Sent off my counterclaim.  So you people said back in March they have 2 weeks to file a lawsuit against me or re-instate my listing.  I don't see how that is fair that I can't sell for 2 or 3 weeks while they putter around dreaming up new ways to harass the innocent. 

 

  Tried calling ebay but that did no good,  especially when I asked for a supervisor.  What i've concluded is ebay no longer has customer service, vero is a kid in a basement and not an actual legal team and red point is another kid in the basement trolling the internet.  

 

   Could i convince the clerk's magistrate's office(assuming that's where i'd go)to waive filing fees proving i'm indigent?  Or is it a money making scheme and they weed out those who can't afford to defend themselves and of course that is what red point counts on?

If eBay removed your listing I am letting you know if you continue doing what you do Ebay will ban you forever. Just stop listing BD Multimedia/Red Point solutions stuff. If Ebay is NOT removing your items then do not worry about it.

Can you explain the situation in detail? What item are you listing? Is it a BD multimedia/red point item, or is it a competing item?

 

eBay cannot possible know all the details about the Intellectual Property status of all 1.5 billion listings on the site. And from a liability perspective, they have absolutely no incentive to ignore a Notice Of Claimed Infringement because that opens them up to potential liability if they get it wrong.

Are you trying to defame me?   What do you mean,  what I am doing?  I'm listing items I purchased directly from the manufacturer.  What do you mean "their stuff"?   They're not the manufacturer.  They're a 3rd party hack breaking the law.

If a company is no longer manufacturing something; say a 'particular shoe' but they use that 'trademark' on 'other shoes'; then doesn't it make sense that the manufacturer still has the rights to all of their brand of shoes?

  On March 24th I got a vero notification generated by a 3rd party agency called redpoint.  They offer some kind of robotic service for manufacturers to identify trademark infringement/counterfeit items.  I submitted a rebuttal,  attaching my sales receipt from the manufacturer Pleaser.  After 2 weeks they ignored me until I intimated I would contact an attorney.  The listing was reinstated shortly after.  

 

  On Memorial day another Pleaser/Demonia item was flagged by Vero/redpoint.  I sent both an email but no reply.  I submitted another counterclaim with sales receipt.  No response so far.  

 

  It has crossed my mind manufacturers will have secret sales channels and this certainly could be the case but I have no proof.  OT: I actually proved that before via the BBB of all crooked organizations.  However I'm hardly competition since the shoe I listed is no longer made.  I have 3 pair.  My prices right now are probably on the high side but then again so is shipping.  So in lieu of that I doubt it's a competition thing.  I believe repoint develops algorithms/programs to automatically find listings.  I'm seeing auto responses and no humans.  

  

  I'm not doing anything wrong.  I'm just trying to get rid of the things and get my money back and a little profit.  Some of the things are rare.  They could use me as a drop shipper and mark things up.  But I really don't think it is that involved.  No one is consciously going after me.  This is a bot company.  They're notorious.  If you search for them lawyers make statements about them being just attack dogs and not knowing anything about the law.
