Hello
I sold a software in a cd form and shipped it to the buyer.He filed a return request claiming the software is not working.On the return chat only proof he provided was telegram chat logs(off ebay) that prove nothing,he didnt even show the problem with the software what ebay is going to do?we are talking about a software worth 500€.I already reported him to the return request chat because he was not addressing the issue and he is just trying to cheat the system.Answers are appreciated

You don't want Ebay stepping in, if you want it returned before refunding.
Accept the return and provide a shipping label.
What did you report the buyer for?

I'm no expert, but I don't think what you're selling is even legal. You're probably lucky you're only being faced with a return (which you should just accept or you'll lose your money and not get it back), and not being shut down completely by eBay and/or facing legal action. I don't know what the laws are like in Greece, but editing EMV chips isn't generally a legal operation.

EBAY does not require customer to "prove their claims". EBAY always rules in favor of the customer. If you ask EBAY to "step in" (you will lose the case and get a "defect" on your account).
Better to just "accept the return" and move on. Remember, customer also have option to "reverse payment" with credit card company (keep both item + your money).
Sorry this happened but it all part of selling online.

Hello he asked ebay to step in but he never provided proof i hope i win i have proof the software works its just that ebay sides with the buyer even though this guy is just probably scamming.

At this point using the return request thing is just a cheat.I have on the description that i dont accept returns only if is not described and the man says the software is defective how is this possible

If you do not refund voluntarily or accept the return and refund, Ebay will refund involuntarily and keep the fees.
He will not have to prove anything.
This software is available on the manufacturer's website for $249.99 so if you accepted an offer for more than this, you probably were asking to have it returned.
It is most commonly used for illegal activities and if there is a legal use, it probably will be a one time use by the buyer who will then do exactly what your buyer is doing.
Not a great decision when you decided to offer this on Ebay.

The buyer does not have to prove anything,
If he says it's defective, it's defective.
That's how ebay is going to look at it.
Just accept the return and when you get the item back, refund the buyer.

The buyer is just in a different world legit he provided photos of telegram chat and also item is not defective when he will send it to me for review i can proove it

Why are you all spying without knowing what he bought ebay told me not to sell x2 emv you are right as it can be misused so stop trying to asssume what the software is?it wont change a thing.I am telling you 100% he bought a working software i dont want to name and the guy says its defective he didn't even tell me the problem how its defective

We know what it is because it is your only Ebay sale. And what you sold is publicly available with no special tools or skills.
We also know that if the communications are by Telegraph, the item is questionable.

There is no proof is this buyer was scamming or not. That's clearly your opinion and outlook and you won't win. If eBay decides that the buyer is correct about defective complaint (and they probably will), they will refund all the money this person paid for this item out of your pocket and you'll get a defect on your account. Seeing as eBay has already pulled some of your listings, this is not advisable in my opinion. You are only setting yourself up for a quicker exit and suspension. Do the right thing and accept the claim or you're going to get hurt. By the way, the feedback you left for the buyer; He bought the software, it works and because he dont know how to use it he filed a return claiming its not working stay away

Returns have been misused from the start.
Everyone knows that. That isn't changing.
Ebay doesn't require buyers to prove their claim. If they say it's defective then eBay will accept that it's defective.
There are too many scam sellers or amateur sellers who don't know what they are selling to question it.

There is nothing to prove -or- disprove.
Accept the return.
When you get the item back, refund the buyer.
