dose anyone else see that this is damaged  seller want it to see if it is damaged pictures were not good enough and e bay stands behind the seller who favors who? 20 years on here and ebay and seller holds my money hostage

From the pictures, can't even figure out what it is, but if you, as a buyer received an item that's not as described, why wouldn't you simply open an ITEM NOT AS DESCRIBED CASE?

I would not buy an item like that one from a seller in Sri Lanka.  Seller claims it was made in the USA, but shipping from Sri Lanka.  Classic drop shipping ;). Problem is that seller has no idea where to have a return sent, and didn’t contemplate returns with his business model.

The extensive negative feedback that you left begins with, "the package came destroyed fed ex picked it back up and they have now lost the package i sent photos of a destroyed statue to seller and they refuse to do anything until it gets returned".  

Stop dealing directly with the seller, who obviously does not understand his responsibilities, nor how eBay works.   The seller's reply to your feedback indicates that he offered to send a replacement, but you do not have to accept that compromise. Here's a link to eBay's buyer protection  policy, which they call the "Money Back Guarantee". You need to file a claim for "Item not as described". The deadline for filing the claim with eBay  is 30 days after the item was delivered.You are of course at a serious disadvantage since eBay might ask you to return the item and FeEx has let you down twice; perhaps you can work something out.

Yes, the seller is a drop-shipper from Amazon ... @thomas7160 could have gotten this same product for $120 direct from Amazon, rather than paying $250 to a middle-man in Sri Lanka.
