Hello there, sold a cell phone as "parts/not working", buyer got it, tried to repair it, didn't succeed and ask for partial refund, something that I refused. Opened a return case and I accept it. Days that ebay set, passed but he didn't post it back. I assume he wants to keep it. What happens now. Should I ask ebay step in and close the case in my favor? Any bids are welcome.

First, ebay actually will give them a couple extra days. I have been through this recently. I called the day after the deadline, they gave them 3 more days before I could call and close it.
Personally, It depends on the value of the item. It's all about my time for money. Ebay will close it on it's own in a week(ish). So, if the time it takes to actually get a hold of someone at ebay is worth the cost of the item, I would do it. If it's not, let it close on it's on own.

Nothing you can do but wait until they decide to close the case.
You can't call anymore and have a case closed.

You can try reaching out to ebay by chat as well, had some success with them closing the case for me on the day it was to be shipped by.

^^ This. Or wait until it times out in about 21 business days since it was opened.
If you call ebay, they will extend the time for the buyer to send it back. Just sit tight.
