Seller posts misleading photos-What recourse do I have in canceling my bid/win?

So I'm pretty new to eBay, last Xmas I made some decent money selling old amiibos that had been sitting in a box since Obama was president.

 

I decided to try and sell more, and found some good bundles on offer up etc.

Yesterday I saw a bundle on ebay, it had 5 photos, all of which showed 5 figures, one of which alone goes for $75. I rather excitedly made a bid, for $85, thinking it was a great deal.

 

I then gave it a double look, and as per the description it apparently doesn't include the most valuable figure, and the sole reason I made a bid in the first place.

 

I immediately reached out to the seller and asked them to cancel my bid-that was yesterday-and since then I sent another message about how the photos were misleading and that I wasnt intending to purchase.

Apparently someone else outbid me today, but since there was only a few hours left, they retracted their bid, leaving me the "winner".

 

I selected that I'd like to cancel this purchase, and havent heard back yet. I know I should've read the description before placing a bid (stupid I know) but I can't help but feel like this seller was doing this on purpose, blatantly showcasing an extra figure that alone goes for more than the other 4, and then hiding the fact that it doesn't in the description, hoping some idiot (IE me) impulsively clicks to bid.

 

I really don't want to pay for this, what recourse do I have here, and what penalties might I incur if I dont pay? I am looking to continue as a seller on Ebay.

 

PS-one last thing to note-the seller has no ratings, so it's not lke they're a well established seller or anything.

As a seller on EBAY, my advise to you is to always read the description on any

listing. Pictures only show what is available, and not always the exact item

the buyer is getting. Very important to read. I, as a seller, put several items

for sale on a listing and tell the customers in the description what the exact

item is that they are getting. There are costs for the sellers even if they give

refunds. READ, READ, READ. Hope this helps.

Lesson learned for sure. Still, I've run across many of these bundle postings for this figure, and never before have I seen one where only 4/5 of what's shown is for sale, especially when the one not for sale is worth more than the others.

 

I can't help but feel like this was a ploy.

If they won't cancel; when you receive; open a return for 'not as described' (if there are items pictured that are not included)

You have a couple of options. Either you 1) don't pay for it where the worst penalty would be an Unpaid Item strike. A couple of those under your belt might restrict you from buying from lots of sellers. Or you could 2) Pay for the item. If, upon receipt, the item doesn't match the description and photos, you'd have the option to open a Not as Described Return request. You'd have to return the items sent before you got your refund... but you don't want them anyway, right?

 

Best case scenario, the seller will absorb the $.30 Transaction Fee and cancel your sale, per your request. Good luck.

Well, as a seller you are required to only supply the item being sold in the picture..NOT any extras.

 

The description AND the photos need to match and NOT mislead anyone.

 

Ebay will side with the buyer as the seller is to blame for the deceitful pictures.

This is an easy one @ryzwi15. Don't pay. You'll get an unpaid item strike. If you don't make a habit of not paying, one strike will not hurt you. If the idea of the strike bothers you, you an appeal to eBay to remove it since the seller's listing violated policy.

do not buy, and sell on the same ID.

The retracted bid seems to have been placed, and retracted days before you placed your bid.

Not sure if it has changed with the new UPI process, but prior to the latest policy, when a buyer officially requested to cancel in the 1st hour, no UPI strike could/would be assessed.

 

As has been posted. 1 won't hurt you anyway, and also there is a procedure for contacting eBay to request that  the 1st one be removed.

Photos not matching what is for sale would be a good reason for removing a strike.

 

Photos............................    likely did not want to take new pics, and no skills to block one item out in the pics.

To expand on this. It is you who needs to read ebay policy. You cant offer choice listings .
