I live in Ireland. I bought a Dual 1219 turntable from Germany. The seller told me he needed to change the shipping company so he could ship to Ireland (by DHL). This turntable has a fragile dust cover so I paid €27 extra by PayPal for split the shipping in 2 boxes one for turntable the other for the cover. We made this extra deal by Ebay chat so this extra payment it's not showing on the Ebay purchases. This turntable has a heavy platter (3.1kg). To ship this turntable properly the platter should be taken out of the turntable and separated on the bottom of the box. My seller didn't do that and then it arrived with the wood base (plinth) completely broken. The seller contacted DHL. He was told that the damage claim should start in Ireland first. I opened a refund request on Ebay. Now he wants me to start the damage claim in Ireland and he is not willing to offer any refund solution. He said that Ebay allow this to sellers. I told that he is responsible to solve this problem and accept the refund request regardless the damage claim. What should I do? Am I in disadvantage with the seller? Thanks very much.

File an "item not as described" with eBay as soon as possible (you have 30 days to do so once the item has been delivered). You are protected by eBay's money back guarantee.
If things work in Europe the way they do here in the USA, the seller will be forced to pay for return shipping and will refund your money once the item is back in his possession.
There is no need for you to get involved with filing claims with the shipping company.
The onus is on the seller to make this right.

Use the MBG and leave it up to the seller what they want to do.
If they want it returned, they'll have to pay return shipping and give a full refund.
If they want to file a claim with the carrier, they should ask for some photos, then refund you and have you hang on to the item and package so it can be inspected.

If you receive any item damaged during shipping you can open a not as described return and the seller will have to facility the return. In the normal process the seller should provide a return label sufficient to send the item back. After the return is done a refund is completed. The seller is obligated to refund you every dime you paid through "Ebay" , anything paid outside of ebay is a roll of the dice. Ebay does not have the ability to charge a seller anything outside of what ebay originally charged through an order which means you have to try to collect from the seller.

Thank you all for helping. I already filed a item damaged refund request. My option was only "item damaged" on the refund request there was no "item not as described" option. Seller has one more day to reply to the refund claim I bet he's not going to reply so I will ask to Ebay step in. We'll see how things go.

if they do accept the return, they probably won't be able to provide a shipping label, since they are in another country,
They will have to send you the money to pay for the return.
