I listed some older software (Older quickbooks CD) on the listing I clearly stated that there are NO RETURNS and to confirm system compatibility before purchasing... however the person that bought it is now saying that the CD-R is empty? and wants a return.. But when I go into deal with the return request my only options are to grab the return in full or to offer a partial return there is no option to deny the return request?
There was an option to contact the buyer which I did send a note but have yet to get a response

Depends on the type of return request (which sounds like the buyer opened for one of the reasons in the red box below)... if the buyer uses one of those then sellers have 2 choices- refund 100% upon return (tracking will show, as well as YOU, the seller, gets to pay for the return label) or 'simply refund'.
No returns ONLY is for 'remorse, NOT for items shown below:

The buyer filed a INAD, so you have a few options.
Refund the buyer and let them keep it.
Accept the return, provide return shipping and give a full refund when something is returned.

Thanks for the answer that makes sense I suppose... so even if you list something as "no returns" The buyer can get around that by selecting one of the red options you noted..

If you really thought that "No Returns" was valid protection if/when a buyer opens an item not as described case, then may I respectfully suggest that you do a quick review of the Money Back Guarantee for buyers?

Yes- because eBay has a 30 Day Money Back Guarantee; says so right on the front of all your listings where you state 'no returns'. Click one of your listings and read up on it as @soh.maryl suggested.
This is done so all the thieves don't come out of the woodwork and ship buyers a 'rock' when they are advertising a Computer.

Another point I might make: If simply stating "No Returns" in a listing would let the seller off the hook, can you imagine the volume of absolute trash that a terrible seller could ship to a buyer if he knew the buyer had no recourse?
You could buy a $1200 computer from me, I could ship you a box of rocks, and you would have no recourse because in my listing I cunningly said "No Returns".

Your other options are you can wait for the buyer to close the return request after sending proof in messages or after a certain amount of time contact Ebay so that they can step in and help you.

I looked forward to seeing real answer to address real concern, but I've not found it. My concern with software is that they can install/copy/activate, THEN ask for return...and still get it. Software doesn't go bad or erase from CDs but clearly you could have gotten one of those buyers. I've lucked out selling some software so I guess most are honest, but as soon as more criminals find out, it'll be open season for free software.
Play their game, get the item back, then contact vendor to check activation. Maybe, hopefully, eBay would back you up if proof that it was 'installed and activated' though told 'blank CD'....but I wouldn't hold my breath.
It's unfortunate to not be able to sell older versions to allow people to save money. Sell locally. The odds of nonsense or INAD nonsense are uuuge...
