So a bit of a long story... I bought a refurbished phone having shopped around for a seller that offered a 1 year warranty. It arrived...all good. But then after a month, an intermittent fault arose that made the phone unusable. No worries, I thought. I can invoke the warranty. I messaged the seller through ebay and they sent me a message that I simply had to return the phone and they would send me a replacement once they had investigated the issue but that unfortunately as it was more than 30 days, I would have to pay for the postage. OK, not the end of the world, I thought. They also told me to request a return, which I did although as I had posted it back, I never printed the label. A month goes by despite lots of chasing from me and the seller claims the phone never arrived with them (although royal mail show picture, signature etc) by which time, the return request I had raised on ebay has lapsed and the case been closed. I can no longer raise a new case for the item on ebay or complain about the seller's shabby treatment of me, I can't invoke the warranty that I had paid for and I no longer have the phone. I may be able to get some money back from Royal Mail but if I were them I would dispute the claim as they clearly have proof of delivery. Surely I should be able to raise this with ebay who should put the seller on a watch list at the very least?

Because
-- you did get a return label, then
-- the case closed when you didn't use the label
means
-- you weren't too late,
-- that was an official eBay return request,
-- and eBay would have forced a refund had you posted that label
-- affixed to a box containing your Royal Mail picture, signature, etc. showing the phone was delivered back.
But now your return at eBay is closed. Do not try to contact eBay or the seller again.
If you paid with PayPal, start another return request here within 180 days, and add a photo of your eBay case to prove that you did have a case on eBay. Then when told to return the phone, upload the Royal Mail tracking to get your full refund.
Otherwise @st3ph3n0 if you used what we call a "credit card" over here in America, ring them from another phone since you returned your phone, and if the phone is engaged and to be married, keep on ringing until you hear the bells, provide your tracking number to file a CREDIT NOT PROCESSED chargeback, and get your refund.
Why Would a Customer File a Chargeback With Reason Code “Credit Not Processed?”
“Credit Not Processed” chargebacks are filed by customers who have returned their purchase but did not receive a refund from the merchant.

You can report a seller here >>> Report an issue with a seller
You have 180 days from delivery to file a claim through PayPal if that’s how you paid, or through your credit card.
Good Luck
