I received 3 counterfeit items. The seller wants them sent back for the refund. Do I have to?

No one just happens to sell 3 counterfeit items. It's clear the seller is a counterfeiter or works for them, which is even more obvious when looking through their account at just how many "rare" items they have lying around for cheap or with company logos photoshopped out. I reported the items with photos showing how obvious it was they were bootlegs and they were taken down from eBay. For my refund, the seller wants them sent back. When they get there, obviously, they will just be resold to another person, who may not realize they've been scammed. I don't feel right about doing that, but do I have to to get my refund? Is there not a better system on eBay for getting fakes out of the market?

If the seller wants to pay to have them returned, you'll have to return them for a refund.

 

Go to your purchase history and click return item and select, the item doesn't match the description as the reason.
The seller will have 3 days to accept the return and pay return shipping or refund without returning.
If they don't, return to the case on day 4 and ask Ebay to step in.

And if you did your homework...if you checked seller eBay ID country and feedback..you would know they are counterfeit to be items mailed to you.

Here's the funny part...you have to return them to China...not sure who pays for shipping but maybe you picked the wrong return shipping reason and you are here to complain to pay for shipping..."seller pays for return shipping" as stated in the 3 sales.

I can't imagine the cost to return them on you to China.

And I kinda expect no respond........

Worldwide policing authorities have not been able to do this, how exactly do you expect eBay to do something about it? The most one can do is report them to eBay, do better screening when purchasing an item from a country that is known to produce knock off.

You don't have to but, if you want your refund then you have to.  The seller will have to send a prepaid return label.

Unfortunately there are many sellers (not saying this seller is unaware) that have no clue they have counterfeit items and may have purchased a lot they are trying to sell. Happens all of the time but you do need to ship back if you want to be refunded. You can report the seller and current listings as counterfeit as well.

If this is an international return - no shipping label will be provided. The seller must provide you funds to return the product. In this case - depending on how you purchased them, up to 3 quotes will be necessary.

 

Open a return for each item purchased & wait the period for a response from seller. If they ultimately do not provide the funds to pay for the return, ebay will likely close in ur favor - you keep the item & get refund. Having done a return to china before, they pay dearly for it. In most cases as well, it sits in their customs forever & is disposed. My return sat in customs for 6 months then was disposed of as abandoned.

As for service - tracking is a must no matter the cost to protect you. Do not let them try & get you to go w/o it.

Yes, it's an international return. What postal service do you recommend that has tracking in China? And the 3 items were sent in the same package, so that's what I'll do for the return. They offered to pay the return shipping, but before I took their money I asked for clarification of their address which was written in Chinese so it was extremely confusing to me but they haven't responded and it's been a few days. If they offered to pay and their address is there (written in Chinese) does their obligation end and it's my fault if I don't mail it back? I'm trying not to make a mistake here as their address is very strange but they aren't replying. Thanks for the help so far.

You can use USPS priority international or a cheaper first class package international. Both will have a tracking available. You can use https://parcelsapp.com/ to track it outside of the US. I was given it years back & the site is amazing outside & inside the US.

 

As to their obligation: that is up to the ebay return case process. Anything received in ebay messages is not part of that process officially. Only messages that are within the return request would apply. Agents CAN consider ebay messages as well but normally its automated & don't get into them.

Open the request, package the return(s) & get price quotes for the return postage they need to pay you via paypal. Force them to accept officially through the return request & obligate them. There normally is a period of time where if they do not respond, ebay can force the return &/or just refund on their own w/o a return.

eBay's Money Back Guarantee for buyers is pretty good.  Have you read it? When an eBay buyer receives an item that's not as described, as  you have, the buyer has 30 days to open an item not as described case with eBay.  The seller then has 96 hours to respond to the case.  He will be required to send the buyer a prepaid shipping label if he wants the item back and to refund in full when the item is returned.  No label? Then eBay will refund the buyer from the seller's funds.  

It's thoughtful of you to be concerned that this seller will just resell to someone else; however, think about this: would it be right for the buyer to be able to keep the item AND be refunded?

If you haven't done so already, open that case.  In the meantime, please read the MBG.

I would humbly suggest that you not bear the weight of the purity of the market on your shoulders.

 

Take care of yourself and karma will sort out the rest.  That's been my experience, anyway.
