How can I and the seller be safe in the case of a cancellation when post office won't ship?

I have a very particular situation in which I don't want to affect the seller negatively;
I recently purchased a collectable Nintendo New 3DS Samus edition from a folk located in Australia. I won the auction, made the payment, and communicated with the seller in a very nice way. All nice and dandy so far.
The estimated delivery date was due on Feb 24th 2022, however the shipping number indicated that there are some delays from Australia to USA. I contacted the seller to see if he/she could figure out what's wrong and he found out that the Australian post office has a 1 month delay to/from USA in every single package. I asked the seller if there was any way for him to ask for the package to be returned, which unsurprisingly he can't.
I really don't want to be outside of the money back guarantee coverage period by waiting waaay longer than expected to receive the item and that particular amount took me a while to get so losing it is not an option in my mind :'( but at the same time I don't want to make a d*ck move on the seller who's been beyond helpful and understanding with the situation. If I place a cancellation request, will the seller be out of the money in case Ebay rules on my favor? please I need to know.

When a buyer cancels (which you probably couldn't do now anyway) it is expected that the buyer will be refunded, that's how it works.
Does the buyer have any idea where the package is? Do you? Is there tracking at all?

Yes I do have a tracking number, we know for sure it's still in Australia's post office as they haven't been able to ship it to the US just yet.
I know that I'd be refunded if the cancellation went through, but that's just half of my concern. I'm also concerned that if I pursued a cancellation that'd mean that the seller would be in a difficult position as the item is quite literally stuck in the Post office. They gave the seller 10 BD before he can get a new update on it. By then I'll be far beyond the money protection program's timeframe

If it's past the estimated delivery date and the package is still in the sellers country, protect yourself and file an Item Not Received case.
The seller can figure out how to get the package back from their end.

I really wanted to avoid doing this and simply bail on the seller considering how nice he's been throughout the whole thing.
At this point I'm left with no choice but to do the claim. I'm worried that he'll be left without the console and the money :'(

The estimated delivery date is Feb 24th. You still have time to wait to see what happens with shipping before opening a claim. The 30 days starts on estimated delivery date.

On 1-28-22 usps updated Australian service was suspended.

The package is coming from Australia. They haven’t suspended service but they are running behind. I can still ship from Canada to Australia although they do warn of delays.

It’s up to you but I would probably wait a couple of weeks to see if the package starts moving. Even if you do get a refund you can repay the seller if the package comes later on.

Buyers cannot cancel, only sellers can....and this is a sold and paid for transaction with the item shipped but stuck in transit.
OP, your options are to sit tight and wait. If you want to file INR, you can, but you can also sit tight and wait. If the item is not what you expect, you can still file through Paypal (if you used it) or your credit card.
