I am right not in the middle of a bait and switch scam here on ebay I sold a full bottle of perfume the buyer said it was to strong and sent me back an empty avon bottle of something else .Everyone is saying that ebay will just let her keep my perfume and take my money to pay her on top of it I am curious if there has been any legal preceding's done to put a stop to this bait and switch that ebay is letting happen ?

I am unaware of legal proceedings to put a stop to this sort of behavior.
eBay is not in a position to determine who is telling the truth in these sorts of scenarios (which must happen by the tens of thousands each day across the platform), and thus will not mediate these sorts of disputes.
Since eBay's position is that the customer is always right, eBay will let her keep the perfume and your money.
Personally, I take the long view: I have made more than enough money here to offset the periodic loss resulting from such buyer behavior.
That does not take the sting out of being cheated... but this sort of thing is a fact of life when selling on line to the general public.
You can report the buyer to eBay, and then block her from purchasing from you again.
(And count your blessings that this was not a $1,000 item.)

That is return fraud. Sad but it's just a cost of doing business here. Just add a bit to all your prices to cover such loss. Like stores do to cover five finger discount.
