Hello;  I've been a loyal honest buyer of stuff on eBay for 13 years with generally excellent luck but ran into a very serious issue with a seller and at the moment am out many many many hundreds of dollars and I'm fearful that a chargeback, which fines the seller,  could trigger a lawsuit  since they can defend even if the claim is legitimate.  We needed  slightly used high end phone and bought on auction from a pawn shop.  The listing had strict 'No Refunds- No Exchange- no partial refunds, as-is' and boilerplate legal disclaimer and advised  the phone only had a 'Bad ESN'.  After trying to set it up, thinking we could unlock it t was determined it was a financed phone that was not disclosed (seller can play ignorance to its origin?)  and there was no way to use on the cellular network.  After a correspondence,  and apology, the seller agreed to a 'courtesy' return, provided a label, and we sent it back, then the seller promptly replied to Paypal Mastercard 'Not qualified for return' and relisted the phone  in their store. The PP MC credit card will chargeback for me, but if the 'no returns no exceptions' policy can be listed as a basis to take me to court racking up additional fees that a 'deal is a deal' is it worth it to defend myself to protect my credit.  I voided my money back guarantee with eBay after filing dispute with PP MC.  Saying they would accept a courtesy return, taking the item back and relisting it and not giving me my money back...stunned. Not on my eBay.

File the chargeback.  The phone was bricked for a reason, non-payment by a prior owner, or stolen, etc...he had no right to even sell it to you in the first place.

 

A bricked phone has no resale value.

I would file a claim with my credit card and let them sort it out. I would not worry about future legal issues because I do not think there would be any. You credit card will decide if the charges are reversed. You were told to return it for a refund and seller provided you a return shipping label so they agreed to the return despite their no return policy. I think you have a good chance of getting refunded.

A debit or credit card banking institution will usually only allow one dispute a month. Have you done any other disputes like with food deliveries, Uber or Lyft, Amazon, eBay, etc., etc.

And a banking institution where you pay many credit cards will usually allow one dispute to all those credit cards where you pay them from your banking institution.

What the seller advertises is meaningless because in order to accept credit card payments they have to provide an item that is as described or they can't accept credit card payments.

 

As is, no returns, no refunds is all bull.

 

Also, you don't do the chargeback, you put in a request, and bases on the evidence a choice is made by the financial Institute, with both sides.

 

This isn't you just grabbing your money back from the register.

 

There are a lot of sellers that try and act scary so they will make you feel how you do and be intimidated.

 I just complained to ebay about how out of 8000 thy kept pulling the "satisfaction guaranteed " scam on me and  refund 2800 worth of product in a month. Nothing was wrong they just resold my stuff also!!!! they did that it was a group of friends too!! I think if their law is flimsy enough to allow customers to be robbed under their guarantee  then they should be liable for our losses . they told me they had no legal dept...not possible.

no they say its not as described . needing no proof and ebay gives the money back. if they ask for return they send back junk and say it was what was sent.
