Buyer Claims Received Empty Box

20 years of selling and this is a first. We sold a $650 item and the buyer stated that they received a empty box. This was a 3lb item that was sent out via USPS Priority mail with signature tracking and full insurance. The customer claims they just now opened the package due to being in the hospital with covid. The buyer simply opened a return. I have the standard 4 options, Accept Return, Give a full refund, offer a partial refund or contact buyer. If i do not reply they will just escalate and it will close automatically and refund. If I reply they can then escalate as well. Surely not offering a refund on a item they received so not sure what we are suppose to do. I for the life of me cannot find any phone number that works to physically call ebay. The contact us simply leads in a big circle. Any advise is welcome.

Bummer.   You will have to refund before eBay does it for you. If you let them, you get a customer service ding and have to pay the FVF too.

 

eBay makes theft like this all too easy I'm sorry to say.

@nifty-tech-llc I have an idea!

 

So is there a way you can get a hold of USPS? I would contact them to see if you can get a letter or something from them that says the item weight. That way ebay has solid evidence that there was something delivered to the buyer. And use that as evidence.

 

Worst case if ebay steps in, you can appeal if you get that proof. I would fight it and not return it if you can get a hold of the Post

Accept return, let buyer know that if your item is not returned you will take this matter to police/report fraud or something similar.

There is a chance that they will not bother with you after that, but if they do return something - film, photograph, report to USPS if there is fraud, call eBay, provide evidence.

 

While it is unlikely that eBay will help with this, there is a chance. 

 

There really is nothing you can do to deny return, but there are things you can do after return happens.

you can accept the return and get your empty box back

 

take the box to the police and file a report and tell them what happened

in the meantime you can file an apeal and get the secret email to send the police report to

doing nothing is going to not work out.you need to step up and take it back

 

police reports can cost money and time for a copy...............maybe 8-10 days

 

filing a police report has worked 2 times for me.you will need a CSR to send you the link to upload reprts when you are appealing  the decision.

Got into chat with ebay customer service and explained the situation. The return has now been flagged as possible fraud and was told to not accept the return. If the case is escalated then Ebay will require a police report from the buyer to proceed. So we are at that step now, waiting it out and see what happens. Most scammers I do not see going to the police to get a report made. Money will be tied up for 30 days but thats better then loosing it for sure.

I have a policy of standing in front of one of my security cameras any time I package any item valued over $500 in case an insurance claim is ever needed and my packing skills are brought into question. Never for a moment thought I might need it to prove I actually packed something up.

 

While it doesn't help you in this case, may want to think about a similar policy in the future just to be safe.

 

As for this case, I agree with the idea they have to return the box. Make them jump through hoops.

Will do! I have the chat log so hopefully it will protect us if a issue does occur. Will post updates as they happen. Hopefully its done and over and in 30 days Ebay releases the  funds. We sell a good bit on Ebay so hopefully 20 years of history helps!

All that standing in front of a camera does not help. That does nothing to prove that the item was really shipped as far buyer saying they received and empty box. A person could show the item being packed then later take it out, which after reading many post on this, would be eBay view because they were not there from time of packaging to dropping off at the shipping center.

This one of those cases where eBay's efforts to make the marketplace more secure and trusted have had unintended consequences.

 

Scammers know that sellers have very little recourse in a case like this. Things don't end well for sellers in a he said/ he said case like this. There is no way to prove what actually took place and eBay tends to side with the buyer to achieve their higher goal of marketplace trust at the expense of the seller.

 

eBay fails to see that it's just as important for sellers to trust the marketplace as it is buyers. 

 

When transactions go south, the burden falls 100% on sellers. eBay invests nothing in reducing anyone's risk or loss. There are some minor protections but not enough. When does eBay intercede on a sellers behalf?

In this case, shouldn't eBay send an email to the buyer that falsely claiming an item did not arrive is fraud., eBay takes these cases seriously and if it turns out that the the claim is fraudulent they will fall up with law enforcement. The same would apply to sellers too.

 

Since we can no longer leave negative feedback for buyers there is no way to alert the community to scam buyers either or to have them fade away after a few transactions as their FB will be get the unregistered.

 

eBay enforces the INAD on every transaction leaving a lot of potential liability on sellers for the whims of buyers.

 

Was it better in the old days when return policies where all sellers choice? Maybe? You can't implement an INAD or empty box scam if there are no returns or returns only upon receipt and acceptance of an item. Sellers can compete on return policies and buyers can make choices on who they deal with based on numerous factors.

 

Now eBay can even return money right from a sellers account.

 

eBay has become, judge, jury, and bank. Yet they have little, if any, of their own skin in the game.

I absolutely agree with glasses -Trailblazer. 

We’re lucky if we get at least .01% back up from eBay. 
All we can hope for is to encounter a buyer with common sense and with conscience. Now a day’s, it quite rare.

Update, so 3 days later the buyer contacts customer service as expected. The decision that was made was the buyer needs to return the item. No strike was given to us. What is odder is there is no return label by Ebay being generated. I am hoping that they are making them get a police report as the original CSR stated. Will update once complete

Case summary Total refund $655.49 Outcome The case was decided in the buyer's favor. More info The buyer provided documentation from law enforcement showing they received an empty box.

 

Appeal has been filed, will update with results.
