Yep you read it right. eBay has a very corrupt system that is restricting me access to a refund. I'm now made up my mind, after chatting with eBay live agent who informed me my refund will not be processed until the seller who is not a registered member of eBay as the sellers account is not a registered account anymore, has a chance to make things right. I never got a message from eBay explaining the situation with the sellers account being shut down by eBay my purchase is waiting shipment and tracking information now shipping label was purchased that I can see on my end. At this point eBay should instantly issue refunds to every buyer who has a open order that is not final and issue a refund immediately to this buyers who have orders still not bought a shipping label for and no tracking provided. Now this seller is not registered on eBay I have to wait three days for the seller to have enough time to issue a refund, the seller doesn't have access to their account no way can the seller communicate to me no way for the seller to issue a refund when the seller no longer has access to a closed shutdown account. Now eBay agents tell me because I made a cancellation request their hands are tied and the seller is the one now but not to worry if I don't hear from the seller in three days I then can contact eBay again and escalate this into getting a refund request begun processing. I believe eBay should of done things significantly better, in this case I never should of had an option to cancel it should of already had a refund being issued. Now eBay blames my actions of starting a cancellation as the reason they can't just issue a refund now,, then when I bring all this to the agents attention they then blame they can't issue a refund not because my actions of making a cancellation request but the polies eBay has to follow once a cancellation request has been made it can not for any reason the cancellation request can't be cancelled. I'm now filling a report to the FTC of eBays actions and eBay policies that are restricting buyers access to their own money in the event eBay make actions that prove to be a negative experience with the financial side of eBay consumers life's. Anyone else with me on this. I haven't found anyway to get reasonable cooperation on this event from eBay agents.

Ignore the customer service rep.
Open the appropriate claim under the Ebay Money Back Guarantee.
If you failed to follow the appropriate procedures, that is your fault.

Ebay has steps that need to be followed to get a refund.
How do you know the seller hasn't shipped the item?
Sellers don't have to provide tracking numbers.

Now that the sellers account is fully shut down this means 100% of everything from this eBay purchase is now forced to be continued off of eBay. This is a direct violation of eBay policies. eBay can't guarantee anything off of eBay.

Have you read the Money Back Guarantee?
What was the last estimated delivery date as seen in the listing?
Has that date passe by at least one, but less than 30 days?
If so, why not open an item not received case?

The seller may have already shipped before the account was removed by eBay.
That would not necessarily be my first guess, but it is at least within the realm of possibility. As long as you follow eBay's money back guarantee timeline, you are still protected against items that are not received or that are not as described, even when the seller is no longer on eBay.

No...If eBay sellers account is shut down eBay is holding the money so you can get a refund as long as you apply correctly within the time frame alloted.
Stop thinking you have to deal with the seller. You don't.
As others have already noted read the Money Back Guarantee and follow the steps. It's automated with no need for contact with the seller or customer service......................

You cancelled the order, but the seller does not have to cancel. You say there is a tracking number. Does it show the package has been received by the carrier? If so, you will have to wait until the last estimated delivery date passes to open an Item Not Received, if you have not gotten the package by then. If the item is not as described, you can open up that type of claim. Even with the seller's account closed, eBay may make you wait the appropriate timeframe before you can ask them to step in.
You may have to do so some waiting, but this isn't a lost cause.

Read carefully there never was a tracking number provided and the USPS facility was still awaiting to receive the order as no shipping was ever provided.

Thank you kindly for all of you who had a genuine interest. I had filed my report to the FTC and the crazy part about all of this was the next day on eBay my refund was issued to me over night. Strange when crime happens here on eBay that automatically it's the victim that has to work with eBay policies that favor the people on hear who act out in violation of not just eBay but the law as well. I would of had to wait at least a week longer than I did to get my money back. Also I still never received a package or any tracking number.
