First of all, where is the "Report Fraud" link?
The fact that this has been so difficult to figure out how to report this is the reason sellers get away with blatant fraud.
I purchased some Beats by Dr. Dre Studio Buds on Black Friday. They were advertised as brand new, unopened.
They arrived defective and would not work.
I complained to the Seller, and the seller refunded my money, no questions asked, and did not ask me to return the item.
Out of curiosity, I contacted Apple and discovered that the Serial Number used on this product has been used dozens of times, and other customers have come in to the Apple Help desk with a defective product, using this same serial number.
Meanwhile, the listing is no longer active.
I think this seller does a selling blitz, and then removes the post so that I can't click, "Report a Problem" or something. TOTALLY SHADY S***.
Ebay's lack of responsiveness to this probem has made Ebay a total **bleep** show.

When you receive a fake or defective item, use the MBG.
Go to your purchase history and click return item and select, the item doesn't match the description as the reason.
The seller will have 3 days to accept the return and pay return shipping or refund without returning.
If they don't, return to the case on day 4 and ask Ebay to step in.

Every listing has a "Report item" link to alert eBay to policy violations and potential fraud.

Since you are NOT the hired 'expert' on what is and what is NOT fraud, know that you 'reporting' a listing will only have teeth should that buyer get either multiple 'report this listing' reports and/or enough returns due to fraud.
But, the location is the same place for all listings.

I am assuming this is just rant...a lot of things in life are "fraud".
