not sure how to move forward on a bad transaction

 

about a month ago I purchased an item on here--It costs $90 with shipping and UPS said it was delivered

but it was not. I am in fairly good communication with the seller but I am really out of the item and the money.

I filed with eBay and they sided with the seller because UPS said it was delivered. The seller filed a complain with UPS but is there anything else I can do?

First contact UPS and see if the was delivered to your address. If so, you need to take it up with UPS.  If it want to a different address, that is often a scam.   If you paid by credit card, contact your card company.

If USPS shows it was delivered to an address other than your address get in writing and appeal the case with eBay.

If USPS shows it was delivered to your address then it was stolen after delivery. That is on you because you need to have a secure place where your packages are left.

UPS a/k/a OPS said it was delivered on my doorstep --It wasn't I was home with the door open ( sunporch door) at the time of delivery and I would have heard the truck at the very least.

so yes, I am trusting the seller to file with UPS can I file as a buyer as well?

FYI; the seller really did NOT file anything with UPS; there is nothing to file. Tracking shows delivered. Seller has completed their task. 

 

You have to contact UPS and although tracking shows delivered, UPS driver deliveries have GPS Exact Address information, which you need to get from UPS. If items shows delivered elsewhere, then UPS is liable and you would then take it up with them. Not the ebay seller. 

 

If item shows delivered at your door via UPS, then there is nothing that can be done by seller, ebay or UPS.

If you have a UPS tracking number you can see all about it here.  It will tell you the origin/date, size/weight, and most importantly the street address to where it was delivered.  If it is not your address, come back here for what to do:

If it was a USPS tracking number, you will have to take your order details to the post office and get documentation that the parcel was not delivered (nor intended) to your address. 

It is no longer particularly necessary to get written documentation from UPS, FedEx, etc. to prove a fake tracking number was used.  The information is visible online for anyone (even eBay) to see.   Problem is, the automated system and the regular CS will not look.
