eBay money back guarantee does not work!

Hello friends!
I will tell you my insane story with eBay customer support and "Money back guarantee"...
I'm always hunting for good deals on watches and I came across a deal that was too good to be true ...
It was listed from a brand new seller from Italy (I live in Germany and provided my German address).

I said to myself OK. If it is the real deal I will be OK. If it is a scammer I'm covered by eBay so nothing to worry about, right?

WRONG!!!
I have bought the watch on the 6th of August evening and literally after few hours (at midnight) I saw that the watch was already shipped to me and it was with provided tracking number. It was the first red flag for me because how you can ship something at midnight? The tracking number was from USP even taught in the listing it says that he will ship the package via DHL (that was the second red flag). After checking the tracking number things started to get weird.

As you can see tracking shows that:
1: The package was shipped on: 5th of August (one day before I even saw the watch on eBay)
2: Package was shipped from Concord, NC, United States (on the listing says Italy)

3: Package was shipped to NEW YORK, NY, US (I have provided my address in Germany never been to the US in my life)
4: Package weights 42LBS / 20KG (for a watch this is a bit too much)
I said to myself ok, either seller attached the wrong tracking or he is a scammer ...
I have tried to contact the seller, but he didn't respond at all!
After that, I have started to investigate a bit and found a bunch of new eBay profiles that are selling exactly the same item from Italy, France, or even Canada all new profiles were made in the past several days, and all of them sold their listings so there are other people who are scammed!

All these listings are made to scam people!
I have contacted Agent via live chat and provided all the evidence I presented you here.
The agent said that he believes me and the case is clear it is a matter of time for the issue to be resolved in my favor! (I have the chats with the agent downloaded just in case)!!!
This morning I was waking up with the message that the case has been resolved IN SELLERS FAVOUR!!!
THIS IS INSANITY!!!
And this guy has scammed lots of people here on eBay and continues to scam people even now and eBay is tolerating and protect these scammers!!!

Just leave a private message for eBay on Facebook here with your name and so on, and tell eBay you have a weight problem, to get your refund.

eBay has to use an automated system that checks a tracking number for a delivered scan only, the rep entered it into the system causing you to lose the dispute.  There is an option to file an appeal, but you will have to get the information needed from the shipping agency UPS? on their stationary.  Because you are located in Germany or is it Bulgaria, the appeal process may be different than what we can use here in the U.S. where you posted your issue.  So you may want to do an online search for "appealing an ebay decision for buyers (ebay.de)" the German site.

 

Go to a UPS shipping office, and bring proof of you being the recipient, eBay Order Details and Purchase History pages w/ the tracking number on it.   If you used a phone/tablet etc. for the purchase bring that, or print copies of those pages if you used a computer.

 

  At the store ask the clerk to compare the shipping label info address, package type/size/weight to the Order details info. They cannot give out specific information, but they can write a note on company stationary  saying things like; the shipping label's address does not match yours, and if applicable that the package type/size/weight. doesn't match what you should have received. 

The note needs to be signed and dated by the clerk and give the store#.

 

With that info you can file an appeal. When you do there will be a place to upload documentation, a clear photo or scan of the note.  Appeals are looked at by real people and the info you provide will cause you to win. Do the search suggested above to find out how to file an appeal.

You noticed the red flags before you bought, but ignored them. While occasionally you may run across a very good deal when shopping on ebay, in most cases they are scams. Because scammers are clever, and know how to beat ebay's Money Back Guarantee (MBG) policies, you cannot always count on it to prevent yourself from being scammed.  You should weigh that fact before buying any too good to be true priced item in the future.  Also be aware that if you file too many disputes through the MBG you may be limited or banned from using its protections.

 

The link you gave does not work with my server, you you may have to provide a screen shot of the tracking information, translated if possible.

Hello friends.
Thank you for your replies.
After I appealed the decision I won the case. Looks like it is an automated system and scammers know that. They ship the different packages to somewhere else or just using the tracking number on a package that they got. Once tracking shows delivered Ebay Automatically concluded that seller is done their job and rules the case in the seller's favor.
I will gladly say that everything is OK now and I'm expecting my refund hope there are no further problems.
