I located a used shirt and placed it on my WatchList seller listed the shirt as XL and though I accept it might be worn or faded because it is used, the shirt I received though labeled as XL had been washed and dried and shrunk to a medium or mislabeled by the manufacturer. Laying it alongside other Xl shirts, it is notably smaller.  I opened a case but the seller refused to reimburse the money. I may just donate it but will never buy another item from Lotuswaterflows. As a former seller,  I understand the importance of accuracy and as much disclosure as is possible.

I requested a return 5 days after receiving he item.  She declined. I believe she knew it wasn’t an XL which is why she reduced the cost. I can appeal the decision and prove it isn’t XL but I also have the option of donating it.  To be fair, she has very good ratings. I appreciate your feedback.

If the manufacture's label shows it as XL, I'm not sure how you could prove it was otherwise.  Often different manufacture's sizing varies. Did the seller provide measurements in the listing?

 

You mentioned that you requested a return but didn't mention the reason you used when filing the return request.  The doesn't fit reason is deemed by eBay as a remorse return and if the seller has a no returns policy, they can refuse the return.  However, if you had used a NAD reason when requesting the return they could not have refused it without refunding and allowing you to keep the item.

@bilbillbart Now I am assuming you opened the return as INAD (Item not as described)

 

Now with clothing, you generally have 2 choices to open a return reason and win 

 

  1. Item Not As Described (INAD)
  2. Does not Fit (aka SNAD)

And yes, the seller can decline the return, but little do they know, if you ask ebay to step in, they will force the seller to refund you (I call it the wrath of ebay lol) and typically you can return the item for a refund (postage paid) or keep the item with a full return

Isn't "Does Not Fit" a SNAD (Significantly Not As Described) case that ebay rules in the buyer's favor?

I do not believe so.  That would be classed as buyer's remorse.  A NAD (formerly called SNAD) would be one where the item didn't match the description.  If the item bears a manufacture's label showing the size as XL and that is what is in the listing, the item would not be NAD unless the measurements were included in the listing and they didn't match those of the actual item.

I measured it alongside two of my large shirts. I can wear large but prefer XL. It’s a medium. When we sell we have a responsibility to confirm the accuracy of what we are selling. I believe the manufacturer mislabeled the item but the seller didn’t do her due diligence.

Since there is no industry standard a manufacturer's sizing often vary widely.  Comparing this one to another by another manufacturer is a total waste of time.  There is no reason for a seller to question the manufacturer's labelling.  If you see an item on the rack at Wally World marked XL would you you stand in line at the customer service desk and question them as to whether the manufacturer miss labeled it?  Perhaps you would be better off only buying from sellers that give the physical measurements of the garments they sell in the listing and pass on those that only give small, medium, large, etc. sizes.

You have the responsibility to ask for measurements if none are provided.
