Item was purchased on 12/1, received no correspondence or shipment information as of 12/10 so I filed an INR the next morning. Within a day or so, received correspondence that "my dad died from COVID, will ship right out" along with a tracking number. According to USPS, still hasn't been shipped yet as of 12/16 (yes, I know tracking isn't 100% reliable). That tracking number has to be stale by now if the package isn't in the system. I'm willing to give him the benefit of the doubt that it's a legitimate reason for the delay (and I'm not being strung along) but really when's the latest for me to say enough is enough and have ebay escalate the case? BTW, the seller *did* have time to list several more items in the meantime (things that make you go "hmm")

What was the estimated delivery date you saw when you made this purchase?
If more than a few days have passed since that date, you can give the person a little more time, or you can simply open an INR case. You have 30 days past the last estimated delivery date to open a case with eBay.
Have never heard of a "stale" tracking number.

12/10 was the latest date for delivery originally (that's why I filed the INR the next day)

When you file the INR on 12/11 @catnap1972 the deadline to go back to the case to ask eBay to step in and get your refund is 12/16 today before the dispute goes stale.
But if the item eventually arrives, you can either
- refuse the delivery for it to go back to the seller at no charge, or
- repay the seller if you still want the item and it is exactly as it was described.

I would ask eBay to step in as soon as the case will allow you to do so. It's my feeling you've cut the seller enough slack, no matter what the circumstances. If s/he really did purchase a label and provide tracking, s/he could have gotten that package into the USPS system somehow; e.g., postal carriers will pick up a package at a sender's home.
If eBay decides to give the seller more time, so be it. If it doesn't arrive, you'll have more opportunities to escalate it. Whatever you do, DON'T CLOSE THE CASE.

What do you mean by "before the dispute goes stale" after five days? Do you have a source for this advice? That's certainly not what I'm seeing on this page.
Once you’ve let the seller know there’s an issue with your order, they have 3 business days to make things right. After that, you can ask us to step in.
However, if you and the seller are working on a solution, you don’t need to ask us to step in as soon as the 3 business days are up. Most sellers want to fix problems for their buyers, so if you’re still talking, give them a little longer to figure things out. You have up to 21 days after you start your request to ask us to step in.

Welp, didn't even need to respond to it. Ebay refunded payment overnight:
"Unfortunately, we didn't receive valid tracking information from the seller. We're sorry you had a problem with your purchase.
The refund includes the purchase price plus original shipping."
