What can a buyer do when an item is described as brand new but it is clearly very used?

I ordered a paint sprayer, which was not cheap, from a seller describing it as new. Not new other, not open box, but brand new and unopened! When I received the paint sprayer today, it was all beat up and there was paint all inside the containers and flecks of paint on the item itself. I'm not even sure if it has all the original parts. I am very upset, because I have never experienced buying something new on eBay before and it not actually being new. What should I do? It's possible the paint sprayer could work, but I'm not about to test it out before knowing how to proceed. I have already taken pictures to document it. I also do not want to be bothered with having to pack it back up and ship it, as I should not have to ship something back when it was clearly not what I ordered. Also, the seller does not accept returns and I paid $18  for shipping separately from the paint sprayer price. Any insight or advice is much appreciated!

Open a return request using the not as described reason and the seller will be responsible for the return shipping under the MBG.

You can't keep the item AND get a refund.

 

The sellers "no return" policy is overridden by Ebay's Money Back Guarantee.

 

You must go through the Ebay Return Request process. Go to your Purchase History, find the item, click on "Return item" in the "I’d Like to.." menu. Follow the instructions, specifying that the item was not as described. You should be provided with a return shipping label. If not, a few days later you can return to your request details and click on the link to have Ebay step in to help you.

There are sellers who buy returned items from distributors that buy in bulk the items returned to companies like Amazon or Walmart. They tend to use stock pictures rather than pictures of the items they have. This is because they are usually open box items that were returned. The as to why they were returned can very from the buyer changed their mind, returned a gift, or worse the item did not work and they did not want to go through the manufacture for service warranty issues. They list the item as new and do not disclose the condition and rarely test the items.  Most of the time as long as the item works fine the buyers will leave positive or neutral feedback indicating the item was at least opened. Then they run into issues with some of their items not working and end up having long drawn out fights with buyers insisting the item was good and the issues are not their fault but damage cause by the buyer requesting a return. These sellers can be spotted by their feedback. If they have a large amount of feedback indicating not disclosing items they sell were open box or negative feedback for refusing returns it would be good to avoid them. Really stock photos should only be allowed for sellers selling new items for distributors but ebay does not really police this issue.  It is good to look over the sellers with the best price and try to find the one with the best feedback even if it means paying a little more. The good news is you can file a claim and after providing a few pictures proving the bad condition the seller will have to provide you a return label and issue you a full refund after the item is returned to them.

Also there are some funny videos of sellers who buy amazon return items going through the items they bought and figuring out how to resell them on ebay as new items on you tube. There was a series by a really over weight guy who received a used inflatable pool with mold and stagnant water all over it. While he declined to sell the pool he had no issues selling the various bed and bath items that had been in the same box and were also exposed to mold.

You have two choices.

 

Keep the item and move on.

 

Or, file a not as described claim to get your money back, but you will have to return the item, and the seller is responsible for return shipping costs.
