Used cellphone's battery goes dead after 6 hours

Paid $85 for the phone and they sell for $110 new, although are currently out of stock new. I charge it up and disconnect the charger and after about 6 hours just on standby and without even using it, the battery is empty. The description reads as follows:

 

This phone is in excellent working and good cosmetic condition. There are no major scratches, dents or dings. There is normal wear but nothing major. 
 
The phone has been tested using BLANCCO diagnostic software, is 100% fully functional and comes with a 30 day warranty against product defect .

 

There is no mention of battery life or that they don't test or guaranty battery condition like many other phone listings mention. Although it is technically "fully functional" it's pretty much useless as a phone right now.  Would this qualify under Ebay's MBG? Any other suggestions?

You need to file an item not as described case.  On your my eBay page by the item click the return this item button.

Are you sure nothing is running on the phone - like a  backup or restore of your content from another phone?

This was my first thought-- there's probably an app running in the background that's draining the battery. I had to uninstall the Accuweather app from my phone because it did exactly that.

I just had one the other day where the andriod OS was sucking up the battery. Rebooted it and it went back to normal.

 

Also, there is a spot  where you can disable the  Accuweather(or any other) app from running in the background. So you can keep that app if you want, just disable it from running in the background.

The phone was reset when I got it so nothing running on it that I installed.
