Hello. On Sunday, I purchased (yes, I did pay for the item) a phone case, only to realize immediately after payment that I misread the description (I saw looking for a case for an LG rebel 3, the description mentioned "LG Rebel2/Phoenix 3..." It was an honest mistake. I immediately sent a notice to cancel it. About an hour later, the seller marked the item as "shipped", with no message regarding the cancellation request.
I messaged the seller asking why they marked the item as shipped. Either Sunday night or during the day Monday, the seller sent what seemed like a very disinterested reply stating that they would contact their shipper and get back to me. I have neard nothing. I checked on the case this evening, and it seems they have opened an unpaid item case against me, in spite of the fact that I have paid. It also seems that they did not ship the item, as although there is a tracking number, it shows no updates.
Also, I might add that I sent the seller a message about 20 minutes or so ago asking why they marked the item as unpaid.
So, am I getting screwed here? What are my options? Thanks

The item automatically went back to Unpaid when the refund was given, and no that is not an indication a dispute has been opened. You would have received a message saying a UID was opened if one was.

First look at your Paypal account to see if a refund has been issued. If it has not the Unpaid Item Dispute (UID) can be closed by you uploading the paypal info date, amount ebay item number, paypal transaction # and seller name, as a reply to the dispute in the resolution center console. mention the cancelation request.
If you have been refunded give the info from PayPal showing you paid and were refunded. Also mention you requested a cancelation because you purchased the wrong item.
For future reference cancelation requests are just that a request. Sellers do not have to honor them, as it does cost them time, effort, and money. Be more careful before clicking on the Buy it Now button.
If this was a high volume seller, some automatically generate tracking info along with the pull from the shelf order. It may not ship for a day or so if it goes to a warehouse or dropshipper for processing. You're also lucky if the seller s a high volume one that you received a reply so quickly. Often you will not hear anything for days, if at all.

Actually, eBay's messaging system leaves much to be desired and it is quite possible that the seller did not get your cancelation request until much later than when you sent it. Of course, you realize that sending a request to cancel the transaction doesn't mean that the seller is required to do so.
It is likely that your seller is using a drop shipper and that he had already forwarded the order to his supplier when he received your request. Being that it was a Sunday has no bearing on it. However, depending upon the seller's location, it may have already been Monday where he is.
When shopping online, either here on eBay or anywhere else, it is important to take care when ordering. While it may, indeed, have been an honest mistake, the mistake was made by you.
I'm curious as to how they could have opened a UID against you if you had, indeed, paid as you mentioned. What payment method did you use? PayPal?

Yes, I used Paypal. It is showing a pending refund there.
Now, am I misunderstanding what is going on here maybe? Because it doesnt give me the option to reply to it or take any kind of action or anything. The item is listed as an unpaid item on my transactions. is that the same as a UID? it is showing a refund on there as well. But at the same time, it says at the top that the seller can't cancel the transaction because the item is already "shipped".

an ebay purchase is a done deal once you click by it now. do not expect that it will be cancelled. think of it as jumping off a bridge. after you jump, you relize the water is under the other side and your heading for jagged rocks. honest mistake, sure, but little late in the game to change plans. luckily the seller hurled one of those large rocks your way and left a huge bruise but it managed to divert your fall into the water. if your not getting the analogy, the seller did you a favor even if it appears he was being a jerk. send him a thank you and offer to buy the correct one from them.
