Dear eBay community, I was scammed and I want the community to be aware of this new scam method.
Timeline:
I purchased an item I desperately needed on December 27th, the time range of delivery was January 4th to 12th.
the seller had not uploaded the tracking number until the 19th and I had not gotten the item until the 26th(at which point I obviously no longer needed it).
Sometime between this period, weeks before I got the item, I started a return case, but eBay misunderstood stood me and started an “ item not received “ case, although in this instance it was the same thing, but I could not actually return it as I didn’t have the item yet.
Ebay told me I’d get my refund many times, but we had not, so we called on the 31st of January and now they told me I’d get my refund after I sent the item back. So they sent me a label and assured as soon as he gets the item, I’d get my refund. A few days later I sent the item. As the item is in transit to the seller, he opens a case saying I never returned the item(that I only got a few days ago because he sent it late) and eBay says I won’t get my refund because I SENT IT LATE?!?!?!?
So the seller can send an item three weeks late but I have less than 5 days to send it back?
Anyways, escalation team has sided twice with him citing “ deadline policies “, which don’t make sense in this case. Ebay handled this terribly and they have endorsed this scammer, beware of this new scam method. Sellers will ship later and take advantage of eBay’s dysfunctional system while BuyBack protection is useless to the buyer.

Don't talk to eBay or the seller again.
Get your refund from PayPal:
File another return request here.
When you're told to return the item, upload your tracking number to get your refund.
Or get your refund from your card issuer:
Call the number on the back of card @miraclebrands and provide your tracking number to get your refund.

This mess is a result of your mistake.
If the seller was jerking you around, you should have just stopped communicating.
You should have opened INR and NOT a return request on January 13.
But by opening a return request, you need to send something back to the seller and because YOU made a mistake and opened the wrong kind of case, you lost the case.
In paying by Paypal, it doesn't matter how you paid or the card you used. Just go to the payment and open a case for item not received.

Contact eBay here instead.
Provide that tracking number @miraclebrands to get your refund.

You needed it by Dec. 27th , and the estimated delivery dates were not until January 4th to the 12th, but you bought it any way.
You received the item the 26th, a day before you needed it, but you didn't need it then.

eBay did that, not me.
I told them I wanted to return it and they checked it off as item not received, but that’s irrelevant because when I called back to the supervisor they said I’d get the refund anyways as long as I send it back, so no, it’s not my fault.

I have the tracking numbers for everything, but again the supervisor said I’d get a refund once I sent it back anyways.

CS reps are commonly incorrect. That is the why I ask if you kept transcript to prove what they told you.
With out such you can not prove what you were told.

Never even contact eBay CS as they are useless... They will just give you random answers to get rid of you and that's that.
Ebay CS is basically just weeding out those who truly need support and those who contact eBay CS over anything.
Instead of going to eBay CS try forums 1st, then facebook and such. If that does not work next step is chargeback.

I'm pretty sure the OP meant they desperately needed it and ordered the item on Dec 27th and the estimated delivery date was Jan 4-12th. The seller didn't upload tracking until Jan 19th, and it arrived Jan 26th, nearly a month after ordering. At least that's how I read it.
