Paypal denied my return claim, is there a way to appeal?

Hello,i ordered headphones on ebay,they have worked just for a few hours totally, i wanted to return,i didnt test them enough at once and really regret now,only powered on and thats it. Opened a case with paypal and they refused with the reason "you filed the case more than 30 days after the item was delivered".

Is there a way to appeal the denied claim? I tried to contact paypal but there is only an AI answering,no real humans,really frustrayed and dont know what to do,the item is quite expensive... does anyone know how to contact real people on paypal?

In case the original poster did not see the change, effective May 20th of last year, this is what PayPal said:

 

In addition to meeting all other eligibility requirements for PayPal’s Purchase Protection Program, disputes asserting Significantly Not as Described claims must be opened by the buyer in the Resolution Center within 30 days of the delivery or fulfillment of an order or within 180 days of the date a payment was sent by the buyer to the seller, whichever is sooner. The timeframes for opening other disputes asserting other claim types (including Item Not Received, Unauthorized Transactions, or other errors) are not changing at this time.

eBay and PayPal both have a 30 day policy for not as described claims. If it's been more than 30 days you have no appeal.

Pay Pal did give you 180 days to file an INAD claim, but they changed it to 30 days not to long ago.

Thanks,did i understand right that not as described cases will be denied if opened in 30 days? And only not received etc may be accepted?

Since you're beyond Paypal's deadline there's no way to appeal. But if your Paypal payment came from a credit card you can dispute the charge through your card issuer. Even some debit cards offer some level of protection, particularly those branded Visa or MasterCard. You can check with your bank.

But the bank cant just take my money back without a reason without even returning the item? What should i tell the bank?

It seems you may have misunderstood:  (Or missed a word in your message).

The correct statement is that not as described will be denied if NOT opened within 30 days of receipt.

Also, an item not received cases has to be opened within 30 days of the last estimated delivery date with eBay.  

Reviewing eBay's Money Back Guarantee might be a good idea for you.

If this is a credit card you need to call the number on the back of the card and tell them you need to dispute a charge. They may allow you to do it on the phone or they may require you to do it in writing. You simply identify the charge you're disputing and tell them the item was defective. They'll contact the seller and may require you to return the item. But yes, if they find in your favor they'll take the money from the seller and credit your account, just like eBay or Paypal would have done.

Tell the bank the truth. Tell them you purchased an item that has a 30 day return policy and you failed to test them within̈ 30 days but you would like a refund because they don't work. Ask if you can dispute the charge anyway.

Tell the bank the truth, that per the VISA rules for example which the bank agreed to follow, the return policy is null and void and has no bearings when the item is defective and not as described.

And if you haven't yet @gekanukr send a message asking the seller to pay for return shipping. No reply is needed, you just need to ask, that's a comma splice.

 

Then tell the bank the truth again, that the seller must pay for return shipping if they want the defective item back, per VISA rules for example, to get your refund.

Buyers have a responsibility to verify that items are "as described" and working properly within the timeframe required for disputes. 

 

For future purchases, test your items in a timely fashion.
